(A) A preliminary plat shall be prepared by the subdivider as a condition precedent to approval of any final plat, when any of the following conditions exist:
(1) The tract of land to be subdivided contains 20 or more lots;
(2) The tract contains 40 or more acres, regardless of the number of lots; or
(3) The Planning Board or City Commission, upon recommendation by the City Planner, City Engineer or designee, determines that planning considerations necessitate employment of the preliminary plat review process to adequately safeguard public health and safety issues relating to development of the tract.
(B) Unless the preliminary plat application is a part of an approved Subdivision Master Plan, the preliminary plat shall depict the owner’s or subdivider’s entire property holding.
(C) Formal application and the required information for a preliminary plat shall be made to the City Planner by the applicant on forms prescribed by the city.
(D) The City Engineer may require the following additional plans, studies and analyses in conjunction with a preliminary plat application. The documents shall include all information deemed necessary by the City Engineer to adequately protect and preserve the public health, safety and welfare of the applicant and any property impacted by the proposal, and to assure compliance with the provisions of this chapter. Additional plans, studies and analyses:
(1) Preliminary drainage study;
(2) Preliminary water, sanitary sewer, storm sewer and drainage capacity calculations;
(3) Traffic impact analysis (TIA);
(4) Engineered one-line drawings depicting the general layout, configuration and tie-ins for water, sewer, storm sewer and drainage;
(5) Property survey including topographic and/or boundary satisfactory to the City Engineer;
(6) Evidence of submittal for review to all agencies with approval authorities such as county drainage districts, state agencies such as TxDOT or TCEQ, and federal agencies such as U.S. Army Corps of Engineers. This provision shall be liberally construed to afford the City Engineer full ability to confirm interagency notice and coordination;
(7) Example renderings of the typical building(s) proposed for construction in the subdivision;
(8) Renderings of amenities planned or to be constructed for the subdivision;
(9) Any other renderings or examples of architectural standards and/or features such as fences, screening walls or monument signs planned or to be constructed as may be requested by the City Engineer or Planning Board;
(10) Draft deed restrictions and articles of any proposed homeowners association, where applicable;
(11) When preliminary plats are presented by sections, evidence may be required that all previously planned and/or constructed sections have received final plat approvals.
(E) (1) Within 30 days following the date of filing of a completed application for a preliminary plat approval, it shall be submitted to the Planning Board for review and final decision. The Planning Board shall approve, disapprove or approve with modifications.
(2) If approved by the Planning Board, the following special notes and signature block shall be placed on the preliminary plat:
Approval of this Preliminary Plat by the Planning Board and City Commission shall be deemed an expression of approval of the layout submitted on the preliminary plat as a guide to the final engineering of streets, water, sewer and other required improvements and utilities and to the preparation of the final plat. Approval of this preliminary plat shall not constitute automatic approval of the final plat, nor be considered authorization to begin construction or sell lots. Approval of the preliminary plat shall not constitute a guarantee or warranty, either implied or otherwise that all other applicable codes and ordinances of the City of Texas City have been complied with. It shall be the responsibility of the subdivider to ensure that all applicable requirements of the City of Texas City relative to the subdividing and development of property have been met.

(F) Approval of a preliminary plat shall be valid for 12 months from the date of City Commission approval. A final plat application must be formally filed with the City Planner before the 12-month period expires in order for the preliminary plat to remain valid.
(G) Reapproval of a preliminary plat may be applied for at any time after the previously approved preliminary plat becomes invalid. The Planning Board or the City Commission may require changes in the reapproval of a preliminary plat in light of new or significant information or requirements, or changed conditions.
