§ 32.101 DISPOSITION OF UNSOLD PROPERTY.
   Property for which no sufficient bid is offered at a sale pursuant to this subchapter may be kept and again offered for sale, or may be otherwise disposed of as ordered by a Municipal Judge.

FIRE DEPARTMENT GENERALLY
§ 32.115 FIRE CHIEF; OBSTRUCTING OPERATIONS OF FIRE DEPARTMENT.
   (A)   Appointment of Fire Chief; general powers and duties. The City Commission shall appoint the Chief of the Fire Department, who shall be the supervisor of all work in the Fire Department. In all fire emergency situations, the Chief shall be under the direction of and report to the Mayor or his or her designee. The Fire Department and officers and employees thereof shall be under the charge, control and direction of the Fire Chief, subject to such rules, regulations and orders as may be prescribed by the Civil Service Commission and the city.
   (B)   Authority of Fire Chief at scene of emergency. The Fire Chief or his or her authorized representative shall be in charge at the scene of a fire or other emergency under the purview of the Fire Department involving the protection of life or property or any part thereof and shall have the power and authority to direct such operation as may be necessary to extinguish or control any fire, explosion or like emergency, perform any rescue operation, administer pre-hospital emergency medical care until arrival of emergency medical services as directed and authorized by adopted medical protocols, investigate the existence of suspected or reported fires, gas leaks or other hazardous conditions or situations, or take any other action necessary in the reasonable performance of his or her duty. In the exercise of such power, the Fire Chief may prohibit, without use of force, any person, vehicle, vessel or object from approaching the scene and may remove or cause to be removed or keep away from the scene any vehicle, vessel or object which may impede or interfere with the operation of the Fire Department, and any person not actually and usefully employed in the mitigation of such emergency, or in the preservation of life or property in the vicinity thereof.
   (C)   Obstructing operations of Fire Department. Any person who obstructs the operations of the Fire Department in connection with extinguishing any fire or other emergency, or disobeys any lawful command of the Fire Chief, Fire Marshal or officer of the Fire Department who may be in charge at such a scene or any part thereof or any police officer assisting the Fire Department, shall be guilty of a misdemeanor.
   (D)   Continuation of position of Fire Marshal. This section does not repeal the ordinance creating the Fire Marshal and the duties and responsibilities outlined in §§ 32.135 through 32.146 of this chapter.

§ 32.116 ARSON REWARD ESTABLISHED.
   The Mayor is hereby required, authorized and empowered to offer a reward of not less than $500 payable to the person who shall be responsible for the arrest and conviction of any person committing in the city the crime of arson as arson is now defined by the State Penal Code.

§ 32.117 PROCEDURE FOR OFFERING ARSON REWARD.
   (A)   Whenever the Mayor shall be informed that any fire occurring in the city was of an incendiary origin, he or she shall call for a report on the fire by the City Fire Marshal. If the Marshal shall report that the fire was caused by the Commission of the crime of arson, it shall become the duty of the Mayor to offer the reward prescribed in § 32.116 of this chapter, which reward shall be in the form of a proclamation duly issued by the Mayor under his or her official signature and attested by the seal of the city.
   (B)   It shall be posted upon conspicuous places, one of which shall be the City Hall, in accordance with the regulations of the State Insurance Department.

§ 32.118 PAYMENT OF ARSON REWARD.
   Upon information being given by any person causing the arrest and conviction of any person guilty of the specific crime of arson, and upon the final conviction of the person, the informant shall be entitled to receive the reward offered in § 32.116 of this chapter from the city.

§ 32.119 SMOKING PROHIBITED IN AUDITORIUMS, THEATERS AND ROOMS OF PUBLIC ACCOMMODATION; CAUSING FIRE; POSTING OF NOTICE IN ROOMS.
   (A)   Smoking prohibited in auditoriums and theaters. It shall be unlawful for any person to smoke any pipe, cigar or cigarette in the city auditorium or in any school auditorium, theater or motion picture theater in the city.

   (B)   Smoking in rooms of public accommodations; causing fire. It shall be unlawful for any person, as guest or occupant of any hotel, roominghouse, tourist court or other place renting rooms for the accommodation of the public, by smoking or attempting to light or to smoke cigars, cigarettes, pipes or tobacco in any manner in which lighters or matches are employed, or in the disposition of lighted matches, cigars or cigarettes or live embers of any smoking materials, in a careless, reckless or negligent manner, whether willfully or negligently, to set fire to any mattress, bedding, furniture, curtains, drapes or other household fittings.

   (C)   Posting of notice in rooms. It shall be the duty of every person who shall directly as owner, or as operator, manager or agent for another, keep or be concerned in keeping any hotel, roominghouse, tourist court or place renting rooms for the accommodation of the public, to post a copy of division (B) above, plainly printed, with the heading in not less than 14-point type and the body of division (B) above in not less than ten-point type, in each sleeping room of all hotels, roominghouses, tourist courts or other places renting rooms for the accommodation of the public within the city.
