In order to provide more suitable sites for buildings and other uses, improve surface drainage, and control erosion, the following requirements shall be met:
(A) The location, grading and placement of subgrade (base) material of all roads, streets, and parking areas shall be accomplished as the first work done on a subdivision or development. The wearing surface may be placed at the discretion of the subdivider as approved in the final plan.
(B) All lots, tracts, or parcels shall be graded to provide proper drainage away from buildings and dispose of it without ponding, and all lands in a development shall be graded to drain and dispose of surface water without ponding, except where otherwise specifically approved in writing by the Village Engineer.
(C) All drainage provisions shall be of such design as to adequately handle the surface runoff and carry it to the nearest suitable outlet, such as a curbed street, storm drain, natural watercourses or on-site detention areas. Where drainage swales are used to divert surface water away from buildings, they shall be sodded or planted as required and shall be of such slope, shape and size as to conform with village requirements.

The Building Official shall be responsible for the administration of any plan, and if he or she shall find that any of the provisions of the approved plan are not being complied with or performed, or the required performance bond is not provided and kept in full force and effect, the permit shall be revoked until such time as he or she is satisfied that the necessary corrective steps have been completed. The Village Engineer shall furnish such assistance to the Building Official as the latter shall require and request.

No plan shall be accepted for filing and processing, as provided in this chapter, unless and until a filling fee of $50 is presented to Village Clerk. In addition, whenever the assistance of the Village Engineer is used for review of plans or building permits or an aspect of subdivision review, reasonable additional fees shall be imposed in amounts sufficient to offset the Village Engineer's compensation for services rendered.

The village has adopted the regulations herein for the good of the general public and shall administer, interpret and enforce the regulations in a reasonable fashion so that undue hardships are not created. However, this village, its officials, employees, representatives and agents shall not be liable for any damages arising from the application or the failure to apply these regulations to any specific situation.

Whoever violates any of the provisions of this chapter or fails to obey any lawful order of the Building Official issued pursuant thereto is guilty of a minor misdemeanor and shall be fined not more than $100. A separate offense shall be deemed committed each day during such illegal violation or failure continues.
