§ 38.15 PROHIBITED ILLUMINATION DURING BLACKOUT.
   (A)   During a blackout it shall be unlawful, except as otherwise specified under the rules and regulations adopted as provided in § 38.04, for any person:
      (1)   To cause, display, operate, maintain or permit any lights whatever, except within an opaque enclosed structure;
      (2)   To cause, maintain or permit any reflection or leakage of light from any structure;
      (3)   To fail to prevent the display, operation, maintenance, reflection or leakage of light from premises occupied, supervised or controlled by the person.
   (B)   For the duration of any emergency it shall be unlawful to display the following types of illumination:
      (1)   Any decorative street lighting;
      (2)   Illuminated house numbers, except when under the immediate manual control of some responsible person over the age of 18 years;
      (3)   Any type of exterior flood lighting that projects lights upward;
      (4)   All billboard lighting or exterior building lighting, including outline lighting, unless the light or lighting is at all times under the immediate manual control of some responsible person over the age of 18 years;
      (5)   All exterior illuminated signs, all interior illuminated signs visible from the exterior, all show window or other interior lights visible from the exterior, whether in a private home, commercial establishment or any other structure, which are not at all times under the immediate manual control of some responsible person over the age of 18 years;
      (6)   No person shall leave a light on or burning in or upon any structure during the daytime, which during the night time will not be under the immediate manual control of some responsible person over the age of 18 years;
   (C)   It is further provided that additional restrictions may be placed on lights and illuminations by rule or regulation adopted and published, as provided in division (A) above.
   (D)   Any light displayed contrary to the provision of this section, or any violation of the rules and regulations proclaimed, as provided in division (A) above, constitutes a public nuisance, and the same may be summarily abated by any fireman, auxiliary fireman, auxiliary policeman, peace officer, member of the State Guard or air raid warden. Any house, store, building, other structure or premises may be entered by any fireman, auxiliary fireman, peace officer, auxiliary policeman, officer or member of the State Guard or an air raid warden, using reasonable force, if necessary, for the purpose of abating the nuisance by the extinguishment or obscuration of the lights. Any entry made for the purpose of abating, extinguishing or obscuring the nuisance must be reported by the person making the entry to the Chief of Police, or to any person designated by the Chief of Police for the purpose, within a reasonable time, but in no case later than 24 hours after the entry.
