§ 33.01 FIRE DEPARTMENT PERSONNEL.
   (A)   The City Fire Department shall consist of a Chief Engineer, a First and Second Assistant Engineer, and any fire engine, hook, ladder and hose personnel as may, from time to time, be appointed by the Common Council.
   (B)   The Chief Engineer of the Fire Department shall be appointed by the Mayor immediately after assuming the duties of his or her office for a term of four years and until his or her successor is appointed and duly qualified. The First and Second Assistant Engineers of shall be appointed by the Chief Engineer from members of the Fire Department immediately after the Chief’s appointment, which appointment shall be presented in writing under the hand of the Chief Engineer to the Council at its next meeting for confirmation, and they shall hold their respective offices during the term of the Chief Engineer.

   (C)   The respective fire companies may choose or elect out of their own number a captain and any other officers as they may see fit, and in a manner and at times as they may think proper, and it shall be their duty to cause their hose, hooks, ladders and other implements to be conveyed to the place where any fire may happen, and to apply and use the same, agreeably to the direction of the Chief or assistant Engineer, to their several places of deposit and as soon thereafter, as may be, wash and cleanse the same, and they are also required to exercise with the fire implements as the whenever the Chief Engineer shall direct; and if any member shall willfully neglect to perform any of the aforesaid duties, he or she shall forfeit and pay the sum of $2, and if he or she shall neglect to attend at any fire or not perform his or her duty upon the occasion of any fire, without reasonable excuse, he or she forfeit and pay the sum of $2, or be expelled from the Fire Department by the Common Council.

   (D)   It shall be the duty of the secretary of each company to keep a record, upon which he or she shall enter the name of each member, and date of his or her election, his or her age and occupation; and they shall report in writing to the Council the name of each person so elected, the date of his or her election and his or her age and occupation. The Council shall then approve or reject the persons as members of the companies, and it shall be the duty of the City Clerk-Treasurer to notify the Secretary of the company of the approval of rejection.
   (E)   It shall be the duty of the secretary of each engine, hose and hook and ladder company to furnish the Clerk-Treasurer a certified list if the names of the members of their respective companies, on or before June 1 of each year, and the Clerk-Treasurer shall thereupon issue a certificate of membership to each of the members, countersigned by the Chief Engineer, on demand, which certificate shall entitle the holder to the exemptions and benefits set forth in § 33.04(B).
   (F)   The Chief Engineer, each Assistant Engineer and each captain of a company, after his or her election and confirmation, shall take and subscribe to an oath or affirmation for the faithful discharge of the duties of his or her office, and the Chief Engineer shall execute his or her official bond in the penal sum of $500, payable to the city, conditioned for the honest and faithful performance of the duties of his or her office.
