(A) No person privately engaged in the business or practice of collecting garbage, trash, ashes or waste materials from the property of another shall engage in the business or practice without first obtaining a permit therefor as provided in this subchapter. The permit shall be issued on application by, and in the discretion of, the Board, which for cause may suspend or revoke the permit. Before the Board is authorized to issue a permit as set forth in this subchapter, any vehicle to be used in the collection business shall be exhibited to the Sanitation Officer of the County Board of Public Health. The Sanitation Officer shall examine the vehicle and, if found to comply with existing health and sanitation requirements of the city and the state, shall issue an approval of the vehicle which must be submitted to the Board. A copy of the approval shall be retained by the Board at all times in its records.
(B) The approval of the Board, as set forth in division (A) above, and the approval of the County Health Department as to any vehicle to be used shall be issued for a period of one year. The vehicle shall at all times be maintained in a condition equal to the minimum standards established by the County Health Department for the vehicle. The applicant for the permit shall pay to the Board the annual sum of $60 for each vehicle, which shall be deposited in the same fund as the fees collected pursuant to § 55.11 herein. The City Clerk-Treasurer shall issue and is hereby authorized to issue a permit for the year. The permit may be suspended or revoked by the Board on the failure of any vehicle to at any time meet the minimum standards herein established.
(C) In addition to any regulations which may be adopted by the Board pursuant to this section, all licensed private trash collectors shall comply with the following regulations for trash services at any individual residential unit, or any multi-family residential family unit or any commercial structure, to-wit:
(1) The pick-up schedule for refuse handled by the private trash collection service shall be no less frequently than once each week.
(2) The private trash collector shall not provide any trash containers whatsoever to its patrons residing in a multi-family unit of less than five individual residential units, except that it may provide a supply of approved trash bags as defined in § 55.01.
(3) The private trash collector shall not collect refuse from any multi-family residential family unit of less than five residential units from any container whatsoever except an approved trash bag as defined in § 55.01. Included, is a prohibition against any metal or other container which is picked up automatically by fork arms or other methods into a truck or other means of conveyance.
(D) The Board is authorized to adopt regulations regulating the issuance of the permits, the kind of character of the conveyance used, the manner and method of collection, and any other rules and regulations not inconsistent with the provisions of this subchapter. The Clerk-Treasurer shall maintain a record of all permits issued.
