§ 35.18 AUXILIARY POLICE FORCE.
   (A)   Pursuant to the authority of KRS 95.445, there is hereby established an Auxiliary Police Force to perform special duties within the city.
   (B)   The Auxiliary Police Force shall be composed of no more than ten members, each of whom shall be:
      (1)   Twenty-one years of age;
      (2)   A resident of the state;
      (3)   Honest, sober, and discreet, and of good reputation in the community of his occupation and residence;
      (4)   Successful in the completion of standard physical and mental examinations established and prescribed by the Chief of the Police Department; and
      (5)   A graduate of an accredited high school or successful in the completion of generally-recognized high school equivalency tests.
   (C)   The members of the Auxiliary Police Force shall be appointed by the City Commission. Recommendations of the Chief of Police shall be taken into consideration when making such appointments.
   (D)   Prior to engaging in any activity as a member of the Auxiliary Police Force, each member shall take the oath required of police officers by state law, and thereupon shall be considered to be peace officers of the city with all of the powers, duties, and authority thereof. The exercise of such powers, duties, and authority shall be limited to such locations, times, and circumstances as are specifically designated by the Chief of Police; no member of the Auxiliary Police Force shall act without such specific designation and authorization by the Chief of Police.
   (E)   The function and duties of the Auxiliary Police Force shall be supplementary to rather than in substitution for the function and duties of the members of the Police Department. In the course thereof, the members of the Auxiliary Police Force shall be subject to the direction, control, and supervision of any member of the Police Department with whom any such member of the Auxiliary Police Force is assigned to any activity.
   (F)   The members of the Auxiliary Police Force shall be subject to the direct control and supervision of the Chief of Police who shall be responsible for the operation of the Auxiliary Police Force under the general supervision of the City Commission, and the training and activities of the members thereof. There shall be no officers or rank within the membership of the Auxiliary Police Force.
   (G)   No member of the Auxiliary Police Force shall engage in any activity thereof unless he is in possession of a badge and identification card provided by the city and is clothed in the uniform of the Auxiliary Police Force approved by the Chief of Police, unless he is engaged in an activity in which the disclosure of his membership in the Auxiliary Police Force would be detrimental thereto and when such nonuniformed activity is specifically authorized by the Chief of Police.
   (H)   Upon the failure of any member of the Auxiliary Police Force to comply with any of the provisions hereof or of any order or direction of the Chief of Police or any member of the Police Department to which the member of the Auxiliary Police Force is responsible pursuant to the terms hereof, the City Commission may either suspend or terminate the membership of that member in the Auxiliary Police Force after providing the member with an opportunity for a hearing in regard thereto.
   (I)   The members of the Auxiliary Police Force are hereby declared to be agents of the city when they are acting within the course and scope of such membership and pursuant to the rules and regulations of the city and the Auxiliary Police Force. As such, they shall have all of the rights, privileges, and immunities thereof. However, such members are not employees of the city but rather are gratuitous volunteers who are not entitled to any compensation or other monetary benefits or remuneration for their time, services, or expenses, unless specifically authorized and approved by the City Commission.
