§ 94.58 NOTICE OF NONCONFORMANCE; HEARING.
   (A)   In the event that any sidewalk or culvert constructed within or upon any public right-of-way within the city is not constructed, maintained, repaired, or reconstructed to the condition thereof required hereby, the city shall cause a written notice thereof to be mailed by certified mail, return receipt requested, to each person who, according to the records of the County Clerk, owns any interest in any real estate which abuts upon that side of the right-of-way in which the subject sidewalk or culvert is located, with a copy of Ord. 2-4-88, passed 5-12-88, and a notice of the time, date, and place of a due process hearing in regard thereto, which shall be conducted by the City Public Works Commissioner at least 30 days after the date such notice was mailed.
   (B)   The proceedings at the due process hearing required hereby shall include a visual inspection and photographs of the subject sidewalk or culvert by the City Public Works Commissioner, and any oral testimony and other exhibits in regard thereto, which shall be recorded and maintained by the City Public Works Commissioner, along with the findings and conclusions thereof in regard to the construction, maintenance, repair, and reconstruction of the subject sidewalk or culvert to the condition thereof required hereby.
