(A) It is recognized that earth disturbance creates risks of runoff and soil erosion damage. This subchapter establishes guidelines for reducing these risks, but in all cases the property owner and their designers, agents and contractors shall be responsible for any damage directly or indirectly caused by any activity regulated by this subchapter.
(B) The public is hereby notified that the borough, borough employees and borough consultants undertake no responsibility for loss of property, loss of life or personal injury due to activities regulated by this subchapter, even if all regulations and ordinances of the borough are followed.
