(a) No person, corporation, or organization shall conduct a landfilling operation within the City. For the purpose of this section, landfilling shall be defined as the depositing of filling materials which do not comply with Section 1931.06(d)(7) & (8) of the Akron Building Code, adopted and incorporated into Chapter 1321 of the Tallmadge Building Code, and which are obtained from a source outside of the property being filled.
(b) All permits for grading operations as defined in Chapter 1931 of the Akron Building Code may be issued only upon submission and approval of a detailed plan of residential, commercial, or industrial development.
(c) No permit for special grading areas, as defined in Section 1931.06(e) of the Akron Building Code shall be issued except upon an affirmative recommendation of the Planning and Zoning Commission after public hearing on such matter.
(d) Nothing in this section shall prohibit excavation, grading, and back-filling of building foundations and retaining walls as defined in Chapter 1931 of the Akron Building Code.
(e) All grading operations as defined in Chapter 1931 of the Akron Building Code shall be conducted during the hours between 7:00 a.m. and 5:00 p.m.
(f) All permits for grading as defined in Chapter 1931 of the Akron Building Code shall expire six months after the date of issue.
(g) Whoever violates subsection (a) herein shall be guilty of a misdemeanor of the first degree.
(h) Whoever violates subsection (e) herein shall be guilty of a minor misdemeanor.
