521.09 NOXIOUS OR OFFENSIVE USE OF PROPERTY.
   (a)   No person shall erect, continue, use or maintain a dwelling, building, structure or place for a residence or for the exercise of a trade, employment or business, or for the keeping or feeding of an animal which, by occasioning noxious exhalations or noisome or offensive smells, becomes injurious to the health, comfort or property of individuals or of the public.
   (b)   No person shall use, permit to be used or maintain a parcel of land, building or structure so as to create a hazardous, noxious or offensive condition to a person of ordinary sensibilities due to the emission of odor, dust, smoke, cinders, gas, fumes, noise or vibration.
   (c)   No person shall operate or permit to be operated on a parcel of land a snowmobile, all-purpose vehicle, off-highway motorcycle, or other similar vehicle within twenty feet of the property boundary.
   (d)   On a first violation a written or verbal warning will be issued. Whoever violates this section a second time is guilty of a minor misdemeanor. For each subsequent offense, a violation of this section is a misdemeanor of the fourth degree.
