The following definitions shall apply to this chapter:
(a) "Clean-Up Action" means labor, materials and other conduct taken by the City of Tallmadge, its employees, agents and/or assigns, including but not limited to mutual aid and/or the Summit County Hazardous Materials Response Team, to eliminate, identify, isolate, remove, evaluate, test, reduce, dispose of, store, decontaminate, transport, dissipate, or dilute an unauthorized release, discharge or spill.
(b) "Curbside" means close to the traveled portion of the street or roadway but in such manner as to avoid interference with the safe and free flow of pedestrian and vehicular traffic.
(c) "Hazardous material" means a substance (gas, liquid or solid) capable of creating an unreasonable risk to the health or safety of the environment, persons or property.
(d) "Recycling facility" or "material recovery facility" means a facility for the collection, sorting, processing, transfer or sale of recyclable materials for the purpose of reclaiming material there from.
(e) "Recyclable material" means those materials designated by the Ohio Environmental Protection Agency or the local Solid Waste Authority as recyclable, and shall include:
(1) "Newspaper" means used or discarded newsprint which has a minimum contamination by food or other material;
(2) "Magazine" means a periodical subscribed to or purchased from the newsstand which has both the outside cover and the inside pages coated with the same shiny material ;
(3) "Metal food containers" means an aluminum , bi-metal, steel, tin-plated steel, or other metallic can used to package food or beverage products suitable for human or animal consumption ;
(4) "Glass food/beverage containers" means a glass bottle or jar of any shape or size used to package food or beverage products suitable for human or animal consumption;
(5) "Plastic container" means PET and HDPE containers only and no other plastic container is included.
(f) "Unauthorized release, discharge or spill" means any gas, liquid, solid, fire or smoke created or resulting from the materials collected which leaves the hauler's vehicle and enters the air or is deposited in or on public or private property within the corporation limits of the City of Tallmadge and has not previously been authorized by the federal or state Environmental Protection Agency.
