(a) Threshold to Competitive Bidding.
(1) The threshold for the requirement of competitive bidding for all city contracts and expenditures is hereby increased from $25,000.00 to $50,000.00.
(2) The threshold for the requirement of City Council authorization for all city contracts and expenditures is hereby increased from $25,000.00 to $50,000.00.
(3) The threshold for the requirement of Board of Control approval for all city contracts and expenditures are hereby increased from $25,000.00 to $50,000.00.
(b) Exceptions to Competitive Bidding.
(1) A real and present emergency and that determination and the reasons for it are entered in the minutes of the Council meeting.
(2) Professional or personal services whose selection shall be based upon the competence of the professional to perform the required professional service as indicated by the training, education and experience of the professional or firm’s personnel, in particular those within the firm who would be assigned to perform the service, the availability of personnel, equipment and facilities to perform services competently and expeditiously and past performance as reflected by previous clients or the City’s previous experience with regard to such factors as cost, quality of work and timeliness of performance.
(3) Petroleum/Utility purchases.
(4) Insurance purchases that the contracting authority is authorized to purchase, and the contracting authority does all of the following:
A. Determines that compliance with the requirements of this section would increase, rather than decrease, the cost of purchase;
B. Requests issuers of the policies, contracts, plans, or services to submit proposals to the contracting authority, in a form prescribed by the contracting authority, setting forth the coverage and cost of the policies, contracts, plans, or services as the contracting authority desires to purchase;
C. Negotiates with the issuers for the purpose of purchasing the policies, contracts, plans, or services at the best and lowest price reasonably possible.
(5) Inter-Governmental purchases or contracts as permitted in general law.
(6) State or governmental bidding purchases as permitted in general law.
(7) The purchase consists of supplies or a replacement or supplemental part or parts for a product or equipment owned or leased by the City, and the only source of supply for the supplies, part, or parts is limited to a single supplier.
(8) The purchase consists of services related to information technology, such as programming services, that are proprietary or limited to a single source.
(9) Contract renewals.
