1321.02 AMENDMENTS; ADDITIONS; DELETIONS.
   The Akron Building Code as adopted herein is hereby changed in the following respects:
   (a)    General Interpretation. All references to the City of Akron shall mean the City of Tallmadge. Where the terms "Building Official" or "Superintendent of Building Inspections" are used they mean the Tallmadge Building Inspector. Any references to the City Charter shall be deleted.
   (b)   Specific Sections Changed. The following sections of the adopted chapters of the Akron Building Code are changed as indicated:
   Section 1903.09(c) Personnel (Amended).
Personnel of the Building Department shall consist of: a Chief Building Inspector, City Electrical Inspector, Heating Equipment Inspector, City Plumbing Inspector, Registered or licensed Architect, Clerks, Stenographers and such other employees as may from time to time be required to properly carry out the work of the Department.
   Section 1903.11 Qualifications of Chief Building Inspector (Amended)
   (a)    When initially engaged, the Chief Building Inspector shall be between the ages of twenty-eight and fifty-eight years; he shall be generally informed on the quality and strength of building materials, on the prevailing methods of building construction, on good practice in building construction, on the accepted requirements of safe exit facilities, and on the proper installation of plumbing, electrical wiring, heating appliances and other installations for the safety, comfort and convenience of the occupants of the building.
   (b)    The Chief Building Inspector shall be appointed by the Director of Public Service from an eligible list certified by the Civil Service Commission.
Section 1904.20 Permit Time Limitations and Expiration; Fee Applied to New Permit; Refund of Permit Fee.
A permit under which no work is commenced within 180 days shall expire as provided for in Section 1904.13(c). A permit which has expired and under which no work has been or will be done may be refunded up to fifty percent (50%) of the permit fee charge. The determination of the amount of the refund shall be made by the Building Department, and shall be based upon the actual work performed by the City. The original fee may, however, be applied on a new permit for the same owner if the new permit is applied for and issued within one year after the expiration date; provided the permit receipt and card for the expired or unused permit is returned to the Building Department.
Section 1904.23 Permit Fees (Amended).
No permit for which a fee is required by this Building Code shall be issued until the applicant for the permit has paid to the Building Inspector or to the person otherwise designated by this Building Code the fee hereinafter prescribed. Fees shall be calculated to the nearest multiple of five cents (5¢).
Each applicant for a permit shall make a sworn statement or affirmation in writing setting forth, in accordance with a bona fide estimate, the total value of the proposed building, structure, addition, alteration, repair or installation, including the cost of any and all plumbing, electrical, heating and other mechanical equipment, devices, appliances, materials, etc., which will be incorporated therein, and also the value of all labor, regardless of who is to do the work or make the installation.
The fee for a permit for a new building, structure, appliance or installation, and the fee for a permit for an addition, alteration or repair to an existing building, structure, appliance or installation, or to move or raze a building or structure shall be the amount stated or determined as follows:
   (a)   Residential Permits (1, 2 and 3 Family).

for all other buildings the fee shall be fixed by resolution of Council in each case.
   In addition to the fee mentioned above for moving a building on or over a public street or public alley, there shall be a charge of $50.00 for each day over two days that the building remains an obstruction on any public street or public alley, which amount shall be paid to the Director of Public Service.
   There shall also be filed with the Director a bond in the amount of $25,000 before the moving of such building, by the permittee.
   The conditions of such bond shall be that the owner of the building and the person, firm or corporation actually carrying out the work of moving the business shall comply with all the general laws of Ohio and with the City ordinances in the moving of the building, and further that they will indemnify and keep the City harmless from all damage, liabilities, claims, losses, costs or judgments made or rendered against or suffered by the City because of such moving operations. However, in lieu of the bond, a public liability and property damages insurance policy, issued by a solvent insurance company, in the amount of $25,000 may be deposited with the Director of Public Service, providing that the City shall be indemnified by reason of any loss sustained by reason of the liability imposed by law upon the City on account of such moving operations, and that the moving contractor shall also be responsible and pay for all damage caused to the streets, overhead wires, trees and other objects which may be lawfully placed or which lawfully exist in the streets.
   No building or moving permit shall be issued except with the approval of the City Highway Division for the construction, alteration or relocation of any building or structure within or adjacent to the right-of-way limits of any limited or controlled-access highway project or other highway project.
   No person shall knowingly make or cause to be made, either directly or indirectly or through any agency whatsoever, any false or fraudulent statement or knowingly fail to disclose information to the City or any of its officers, agents, employees or departments with the intent that such statement or omission shall be relied upon to cause the issuance of a building or moving permit for the construction, alteration or relocation of any building or structure within or adjacent to the right-of-way limits of any limited or controlled-access highway project, grade separation project or other highway project.
   Whoever violates or assists in the violation of any provision of this subsection shall be guilty of a misdemeanor and fined not less than $50.00 nor more than $500 or imprisoned not more than ninety days, or both.
   In addition to the above mentioned fee for moving a building on or across a public street or public alley, a permit fee shall be paid to the City of Tallmadge as follows: for a foundation with no basement at the new location for building moved over a public street or alley, the fee shall be as provided in subsection (c) hereof.
   When a basement is to be provided at the new location, the fee for the permit for the new basement including the foundation shall be at the same rate as is provided in this section for an addition.
   (e)   To Raze a Building:
The sum of $25.00 for each 1,500 square feet or fraction thereof of the total floor area. The floor areas of every story, except the basement, using outside dimensions, shall be added. A separate permit shall be required for each separate building.
   (f)   Tent:
The fee for a permit to erect or re-erect a tent shall be based on the ground area covered by the tent and shall be as follows:

1904.29 - Reinspection Fee; Penalty for Commencing Work Without Permit (Amended).
   
   (a)   Reinspection. The fee for a reinspection when violations are found, or when inspectors are called to inspect work that is not completed shall be $30.00.
   (b)   Penalty. All fees for permits to be charged by virtue of any section of this Building Code, either in its present or amended form, shall be subject to an increase of two hundred percent (200%) if the work for which the permit is required is commenced before the permit is issued or written consent of the Superintendent of Building Inspection is procured, which increase shall be collected by the Superintendent before the issuance of such permit.
Nothing in this section shall be construed to repeal or modify any other section of this Building Code providing for penalties, and the penalty provided herein shall be in addition to any other such penalty.
1904.33 - Material and Debris on Streets and Suspension of Permit (Amended).
   (a)    No contractor, builder, or any other entity, or individual having been issued a building permit, shall cause to be deposited or fall thereon material, earth or any debris over or upon any dedicated street in the City while acting or in conjunction with the use of such permit.
   (b)    Upon violation of subsection (a) hereof, upon determination by the Building Inspector that it is for the best interest and welfare of the City the Building Inspector may require all further work to be stopped and may require suspension of work until the condition in violation has been remedied. It shall be the responsibility of the Building Inspector to issue written notice to such person to whom the permit was issued, or by posting upon the property where such permit is posted that there is a violation of subsection (a) hereof.
