(a) The Police Department shall, from time to time and at least four times a year, inspect that portion of each sexually oriented business open to the public and adult motel licensed under the provisions of this chapter in order to assess compliance with the provisions of this chapter.
(b) The Director of Public Safety shall, from time to time and at least four times a year, request in writing that the Health Commissioner inspect that portion of each sexually oriented business open to the public and licensed under the provisions of this chapter in order to assess compliance with the provisions of this chapter and relevant Health Department regulations.
(c) An applicant or licensee shall permit the Building Inspector and representatives of the Police Department, Fire Department, or other City departments or agencies, or the Health Commissioner, to inspect that portion of each sexually oriented business open to the public or adult motel for the purpose of insuring compliance with the law, including relevant Health Department regulations, at any time that it is occupied or open for business.
(d) A person who operates a sexually oriented business or his agent or employee commits a misdemeanor of the first degree if he or she refuses to permit such lawful inspection of the premises open to the public. (Ord. 87-1999. Passed 11-11-99.)
