721.08 REVOCATION OF REGISTRATION.
   (a)    Any registration issued pursuant to this chapter may be revoked for good cause. Good cause shall include but not be limited to:
      (1)    Willfully or by reason of incompetence, repeatedly (i.e., two or more times within two consecutive calendar years) violates, by a showing of clear and convincing evidence, any state or local law regulating construction, building, or related licensing or registration; or
      (2)   Uses his/her registration to obtain a permit for another; or
      (3)   Provides any false, misleading, or incomplete information when making application for registration or renewal; or
      (4)   Fails to secure permits, inspections, and/or approvals as required by the Tallmadge Building Code; or
      (5)   Fails or refuses to promptly correct an installation or part thereof made in an incompetent or improper manner after notice thereof by duly appointed inspector of the Building Department; or
      (6)    Fails to timely notify the City of Tallmadge Building Department of receipt of a notice of suspension or revocation of any license issued pursuant to Ohio R.C. Chapter 4740; or
      (7)    Fails to timely notify the City of Tallmadge Building Department of termination of required general liability insurance, workers' compensation coverage, expiration of the license issued by the Ohio Construction Industry Examining Board, or notice of noncompliance with Tallmadge municipal income tax requirements as provided in this chapter; or
      (8)    Fails to maintain a current license as required by Ohio R.C. Chapter 4740 and/or this chapter.
   (b)    The Building Official for the City shall notify the person or entity that the registration is recommended for revocation by mailing notice of same by certified mail to the address provided on the current registration or renewal application. The notice shall include the reason for the recommendation.
   (c)    The Director of Public Service shall hold a hearing on the recommendation within thirty (30) days of the date of the Building Official's notice. The registered individual may be represented by legal counsel and shall have the opportunity to be heard.
   (d)   The decision of the Director of Public Service may be appealed to a court of competent jurisdiction pursuant to law.
