(a) No person, with intent to defraud, shall sell or offer for sale, any food product or any other article of merchandise, the kind, number, quantity, quality, weight or measure, or brand thereof which is falsely marked or indicated thereon or on any package in which the same is contained, or is otherwise falsely represented in any manner in the sale or offer for sale thereof.
(b) Whoever violates this section is guilty of a misdemeanor of the third degree.
