743.03 APPLICATION FOR LICENSE.
   (a)    Applicants for a precious metal dealer's license under this chapter shall file with the Director of Public Safety a written, sworn application on a form provided by the Director, which application shall be signed by the applicant if an individual, by all partners if a partnership, and by the president if a corporation and shall set forth the following information: name, date of birth, social security number, nation of citizenship, location of place of business, past criminal record and whether previously engaged as a precious metal dealer and when.
   (b)    Applicants for a precious metal dealer's license under this chapter shall furnish to the Director of Public Safety a set of fingerprints.
   (c)    All applications for a precious metal dealer's license under this chapter shall be filed with the Director of Public Safety at least thirty days prior to the desired date of issuance of such license.

743.04 ISSUANCE OF LICENSE
   (a)    The Director of Public Safety shall issue a precious metal dealer's license or deny the issuance of such a license within thirty days from the date of application.
   (b)    A precious metal dealer's license shall not be issued to any person who:
      (1)    Has been convicted of any felony within the five years immediately preceding the date of the filing of the application;
      (2)    Has been convicted of any crime involving moral turpitude within the five years immediately preceding the date of the filing of the application;
      (3)    Has made any false statement or misrepresentation on the application.
   (c)    A precious metal dealer's license issued under this chapter shall not be transferable and shall expire on June 30 of each year.
   (d)    The annual precious metal dealer's license fee shall be twenty-five dollars ($25.00) per year.
   (e)    The precious metal dealer's license issued under this chapter shall be displayed in a conspicuous place in the dealer's place of business. Each person receiving such a license shall place over the principal entrance of the place of business a sign designating that the dealer is a licensed precious metal dealer.

743.05 RECORD OF TRANSACTIONS.
   Every precious metal dealer licensed under this chapter shall keep and use such books and forms as shall be approved by the Director of Public Safety, in which shall be legibly written in ink and in the English language, at the time of each purchase, an accurate description of the goods, articles or things purchased, with the name, age, place of residence, driver's license number or other personal identification and a brief physical description of the person of the seller. The licensee shall also record in such book all identifying letters or marks inscribed on any of the articles which he purchases.
   Such book shall, at all times, be open to inspection by the Director of Public Safety, the Chief of Police, and all members of the Division of Police. Upon demand of any of the aforementioned persons, the licensee shall produce and show an article thus listed and described which is in his possession.

743.06 REPORTS TO POLICE.
   Each licensee under this chapter shall once a week report to the Chief of Police on forms prescribed by the Director of Public Safety and furnished by the Division of Police, a description of all articles purchased by him for the week immediately preceding.

743.07 PROHIBITIONS.
   (a)    No precious metal dealer shall purchase or otherwise acquire any article from any person who is under eighteen years of age.
   (b)    No precious metal dealer shall purchase or otherwise acquire any article from any person who at the time of the transaction is intoxicated.
   (c)    No precious metal dealer shall purchase or otherwise acquire any article which he knows or has reasonable cause to believe has been obtained through the commission of a theft offense.
   (d)    No precious metal dealer shall purchase or otherwise acquire any article bearing evidence of a serial number or other identifying mark which has been tampered with, scratched or otherwise obliterated, unless such person immediately contacts and receives approval from the Division of Police.
   (e)    No precious metal dealer shall purchase or otherwise acquire any article prior to examining the identifying credentials of the person selling or transferring such article to the precious metal dealer.

743.08 ARTICLES TO BE RETAINED.
   No precious metal dealer shall sell, melt, alter, deform or dispose of any article received by him until the expiration of fifteen days after delivery to the Chief of Police a copy of the report required by Section 743.06.

743.09 CONFLICT OF LAW.
   In the event of conflict between any provisions of this chapter, including any rules and regulations adopted pursuant to its provisions and any other provisions of the Codified Ordinances, including any rules and regulations adopted pursuant to such Ordinances, the more restrictive provision or provisions shall prevail and control.
