§ 37.02 MUNICIPAL COURT BUILDING SECURITY FUND.
   (A)   The City Council hereby creates a Municipal Court Building Security Fund which shall be used only for providing financing for items used for the purpose of providing security services in the municipal court building.
   (B)   (1)   A defendant convicted of a misdemeanor offense in the Municipal Court of the city shall pay a Building Security Fund fee in the amount required by the city fee schedule.
      (2)   For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
         PERSON CONVICTED. A person is considered CONVICTED if:
            1.   A sentence is imposed on that person;
            2.   The person receives community supervision, including deferred adjudication; or
            3.   The court defers final disposition of the person’s case.
   (C)   The Municipal Court Clerk shall collect the costs described herein, and promptly pay the funds to the proper officials of the city and all funds collected under this section shall be deposited in a fund to be known as the Municipal Court Building Security Fund. The Municipal Court Building Security Fund shall be administered by or under the direction of the City Council. This Fund shall be used only to finance items used for the purpose of providing security services for the municipal court building, as appropriate, including:
      (1)   The purchase or repair of X-ray machines and conveying systems;
      (2)   Handheld metal detectors;
      (3)   Walk-through metal detectors;
      (4)   Identification cards and systems;
      (5)   Electronic locking and surveillance systems;
      (6)   Bailiffs, deputy sheriffs, deputy constables, police offices or contract security personnel during times when they are providing appropriate security services;
      (7)   Signage;
      (8)   Confiscated weapon inventory and tracking systems;
      (9)   Locks, chains, alarms or similar security devices;
      (10)   The purchase or repair of bullet-proof glass; and
      (11)   Continuing education on security issues for court personnel and security personnel.
