§ 151.04 PERMISSIBLE PARKING OR LOCATION.
   (A)   A HUD Code manufactured home may be placed, located or permitted to remain within the corporate limits of the City of Sweeny, Texas, if and only if, it is situated:
      (1)   In a manufactured home park licensed pursuant to the terms of this Code of Ordinances;
      (2)   In a duly platted and recorded manufactured home subdivision, which meets all the requirements of this Code of Ordinances;
      (3)   Upon a site that such manufactured home has continuously occupied prior to and since the effective date hereof, provided such occupation was lawful on that date, and further provided that the continued occupation thereof does not pose a significant threat to the health or safety of persons within the manufactured homes or others. The term SITE as used in this division and division (A)(4) following means the lot or lots on which the manufactured home is located;
      (4)   The exemption for existing manufactured homes shall apply to the manufactured home being occupied prior to and at the time of the adoption of this section as defined in division (A)(3) above, and shall include any replacement manufactured homes for such site provided that such replacement is made within three months of the date the existing manufactured home being replaced has been removed, damaged or destroyed, if the replacement manufactured home meeting HUD Code manufactured home standards can meet the setback, distance, and all other requirements found in this Code and provided that the replacement manufactured home is not more than five years old.
   (B)   It shall be unlawful for any person to park, place or locate a manufactured home at any location not authorized by this chapter, or to permit or allow any manufactured home to remain within the corporate limits of the city in any location not authorized pursuant to this chapter.
   (C)   Any manufactured home lawfully placed, parked or located within the corporate limits of the City of Sweeny, Texas, shall conform to all the requirements of this chapter, concerning specific use permits, setbacks, anchoring and skirting, and any other requirement imposed by this chapter.
   (D)   A recreational vehicle may not be placed or parked on any property except as specifically permitted by this chapter.
   (E)   Any person, firm or corporation who desires to park or locate a HUD Code manufactured home as permitted in this chapter, shall make application for a use and occupancy permit with the Building Official of the City of Sweeny, Texas. The fee for the use and occupancy permit can be referenced on the city's master fee schedule. Before granting such permit, the Building Official shall insure that the following requirements are met:
      (1)   Setbacks. No HUD Code manufactured home may be placed on any lot or tract within the city in such manner that any part of the manufactured home or any extension thereto is situated within ten feet of any side lot or tract land so occupied, and is set back less than 20 feet from the front line. The front line is deemed to be the line of the tract or lot which adjoins a street or roadway upon which there is situated either street numbered houses or businesses or a combination of both. Whenever the lot or tract of land is situated at an intersection of two different streets or roadways, the manufactured home or any extension thereof shall not be parked nearer than ten feet from the inside lot or tract line, and not nearer than 15 feet from the side lot line adjacent to the street intersecting the street upon which are situated homes or businesses which have street addresses, and not nearer than 20 feet to the front property line.
      (2)   Anchoring. Prior to connecting any HUD Code manufactured home to the water, sewer and/or gas service of the city, in accordance with the Plumbing Code of the city, the manufactured home shall be anchored in accordance with the manufacturer's installation instructions, and anchored, as well as supported and blocked, in accordance with those standards for manufactured housing found in the Administrative Rules of the Texas Department of Licensing and Regulation, 16 Tex. Admin. Code Chapter 69, adopted pursuant to the authority of Tex. Rev. Civ. Stat., Art. 5221f and administered by the Texas Department of Housing and Community Affairs.
      (3)   Skirting. In addition to the anchoring and blocking requirements specified above, any HUD Code manufactured home shall be properly skirted prior to being allowed to connect to the water, sewer and/or gas service of the city. Skirting shall be required around the complete perimeter of the mobile home in accordance with the following minimum specifications.
         (a)   The following material, or its equivalent as approved by the appropriate city officials, is approved to be used for skirting:
            1.   Manufactured skirting with vent panels;
            2.   Corrugated steel sheets;
            3.   Galvanized steel sheets;
            4.   Aluminum sheets;
            5.   Plywood sheets, with a 3/8 inch minimum thickness, rated for exterior use by the manufacturer;
            6.   Oriented strand board, with a minimum 3/8 inch thickness, rated for exterior use by the manufacturer; and
            7.   Brick or concrete blocks.
         (b)   Screened vents are required to be used with all skirting to allow for air circulation under mobile home.
   (F)   Any person, firm, corporation, association or other entity that violates this section shall be subject to a fine specified in the general penalty provisions of § 10.99.
