§ 94.04 REPAIR OF NONCONFORMING BUILDINGS AND STRUCTURES.
   (A)   (1)   Except as to the roof, as provided in division (B) below, no frame, wooden or corrugated axon or sheet metal building, shed or other structure of any kind heretofore constructed within the Fire Zone aforesaid shall be repaired in any manner unless and until the plans for the proposed repair work shall have been first submitted to the City Council, together with an accurate estimate of the cost of the work and an accurate appraisal of the then value of the building or structure upon which the repair is proposed of be made. Upon receipt of the plans, accurate estimate of cost and accurate appraisal aforesaid, the City Council shall hold a hearing to determine whether or not the work shall be permitted within the Fire Zone of the city.
      (2)   If, in the opinion of the City Council on the hearing, the cost of the work equals or exceeds one-fourth of the then value of the building or structure, not taking into consideration the then value of any repair previously authorized by the City Council, as fixed by the Council, the Council shall enter an order prohibiting the repair as hazardous from the standpoint of fire, and it shall then be unlawful for any person, firm or corporation to proceed with the repair or to cause the same to be done.
      (3)   It is likewise unlawful for any person, firm or corporation to commence any repair without first submitting the plans of the repair, showing the material to be used, accurate estimate of the cost of the repair and accurate appraisement of the then value of the property to be repaired to the City Council. The City Council shall have authority to appoint an inspector or inspectors and to employ contractors or other experts to assist it in arriving at the value of the improvements and the value of the building or structure.
      (4)   No repair of, extension on, nor an addition to, any building or structure within the Fire Zone of the city shall be made, except upon application by the owner to the City Council for a permit to make the repair, extension or addition to the building or structure, and no permit shall be granted in any case unless it shall appear to the satisfaction of the City Council that the proposed extension, repair or addition will not increase the existing fire hazard nor increase the key fire insurance rate in the Fire Zone.
   (B)   The roof of any frame, wooden or corrugated iron or sheet metal building, shed or other structure, within the Fire Zone above described, and in existence at the time of the adoption of this chapter shall not be repaired with the use of any kind of material, except that described in § 94.02. In the event that the repair does not exceed 25% of the area of the roofs, then, in that event the City Council may permit the repair with the use of the same material with which the roof was originally constructed, provided that the owner of the building, shed or other structure shall file an application therefor and in filing the application, the procedure provided in division (A) above shall be followed.
