(a) Beginning April 22, 2024 (Earth Day), the Borough Manager or their designee shall have the authority to enforce this chapter and issue citations for violations thereof.
(b) A retail establishment that violates the requirements of this chapter shall be subject to a civil penalty as follows:
(1) Fifty dollars ($50.00) for a first offense;
(2) One hundred dollars ($100.00) for a second offense; and
(3) Two hundred dollars ($200.00) for a third or any subsequent offense.
(c) For the purposes of enforcement under this chapter, an offense shall be each day a retail establishment is violating a requirement of this chapter.
(d) In addition to the penalties set forth in this chapter, the Borough may seek legal, injunctive, or other equitable relief to enforce this chapter.
(e) The failure of the Borough to enforce any provision of this chapter shall not constitute a waiver by the Borough of its rights to future enforcement hereunder.
