(A) Generally.
(1) It shall be unlawful for any person, partnership or corporation to sell, keep for sale or give away in the course of trade any cigars, tobacco, cigarettes or cigarette material to anyone without first obtaining a license from the Clerk-Treasurer.
(2) The applicant shall file a written application stating the name of the applicant, exact location of the place of business and shall deposit with such application a license fee in the amount as stated in Ch. 37. The license shall then be issued by the Clerk-Treasurer and the license fee transferred to the local school district.

(B) For sale; application; contents; fee. Every person, partnership, limited liability company or corporation desiring a license to sell tobacco at retail shall file with the Clerk-Treasurer a written application, on forms provided by the municipality, stating the name of the person, partnership, limited liability company or corporation for whom the license is desired and the exact location of the place of business and shall deposit with the application a license fee, the amount which is on file in the office of the Clerk-Treasurer. If the applicant is an individual, the application shall include the applicant’s Social Security number.
