4-3-11: VIOLATION; PENALTIES:
Any person violating any of the provisions of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished as provided by section 1-4-1 of this Code. A separate offense shall be deemed committed upon each day during or on which a violation occurs or continues.
   A.   In addition to the other remedies provided by this section and law, violation of any provision of this chapter, by any person (or such person's agent, contractor or subcontractor) engaging in construction activity and to whom a building permit has been issued may result in the issuance of a stop work order pending a hearing by the City Council to determine the conditions under which further construction activity shall be permitted.
   B.   After being notified by the City of a violation under any provision of this chapter, and in the event said person fails to cure said violation within twenty four (24) hours of notification, then the City may issue a stop work order on said person's construction project which shall remain in effect until the City Council conducts a hearing to determine the conditions under which further construction activity shall be permitted.
   C.   "Stop work order" is defined as a written document issued by the City building inspector in consultation with the City Police Chief, instructing said person and said person's agents, contractors or subcontractors to immediately cease any and all construction activity or work on the person's construction project until the City and the person have conducted a hearing to determine the conditions under which further work shall be permitted. It shall be unlawful to do or perform any construction activity in violation of such stop work order. A stop work order shall not be considered a recovery or penalty so as to bar any other penalty or remedy being enforced.
   D.   Such hearing shall be conducted within ten (10) days from the delivery of a "stop work order" as defined herein.
   E.   Within three (3) days following conclusion of the hearing, the City Council shall set forth, in writing, its findings of fact and conclusions of law and conditions to further construction activity and deliver the same to said person.
   F.   In the case of construction activity for which a building permit was not required, a stop work order may be issued and no construction activity may recommence except upon the conditions imposed by the City Council in its findings of fact and conclusions of law following a hearing as provided herein.
