351.14 PARKING ON THE SQUARE; RESIDENTIAL PARKING PERMIT.
   (a)   Vehicle parking shall be limited to two hours from Monday through Saturday during the hours of 8:00 a.m. to 6:00 p.m., holidays excepted, on the exterior of the following streets as designated:
      (1)   Cherry Street between Columbus Street and - Vernon Street;
      (2)   Granville Street between Columbus Street and Vernon Street;
      (3)   Vernon Street between Granville Street and Cherry Street (except one fifteen (15) minute parking space from the hours of 11:00 a.m. to 11:00 p.m to be located on the east side of Vernon Street between Cherry Street and Granville Street (nearer to Granville Street) and a second fifteen (15) minute carry-out parking space between the hours of 6:00 a.m. to noon (Monday through Sunday) to be located on the east side of Vernon Street between Cherry Street and Granville Street generally toward the northern end of the block adjacent to businesses with carry out clientele.
   (b)   Vehicle parking shall be limited to two hours from Monday through Saturday during the hours of 8:00 a.m. to 6:00 p.m., holidays excepted, on the interior of Columbus Street between Cherry Street and Granville Street.
   (c)   Signs establishing the two-hour limit shall be erected along the exterior of the subject streets.
   (d)   Vehicle parking shall be limited to fifteen (15) minutes in one designated parking space from the hours of 11:00 a.m. to 11:00 p.m. daily to be located on the east side of Vernon Street between Granville Street and Cherry Street (closer to Granville Street).
   (e)   For violation of the parking regulations established in subsection (a) hereof, the following penalties are established:
      (1)   If paid within twenty-four hours of the violation: $5.00
      (2)   If paid after twenty-four hours and within fourteen days of the violation:
         $10.00.
      (3)   If paid after fourteen days and within thirty days of the violation: $20.00
      (4)   After thirty days of the violation a summons shall be issued.
   (f)   Tickets issued on Friday or Saturday and paid the following business day shall be considered to have been paid within the 24 hour time period.

351.15 PARKING LOTS.
   (a)   Definitions.
      (1)   "Public parking lot" means any land owned by or having been dedicated for a public use, other than as a street or alley, to the Municipality, the State or any subdivision or school district thereof, and which is improved to accommodate travel by motor vehicles, and upon some portion of which parking of motor vehicles is invited or permitted, expressly or impliedly, whether by publicly or privately owned motor vehicles, or both, and whether for a consideration or not.
      (2)   "Private parking lot" means any land of any owner, other than any of those mentioned in the definition of "public parking lot," which land is improved to accommodate travel by motor vehicles, and upon which four or more motor vehicles can be parked simultaneously without blocking ingress and egress of other cars, the operators of which are intending to park thereon or to travel thereon for any purposes intended to be accommodated by the owner, and upon which land the owner invites or permits parking by other than motor vehicles in the owner's service.
      (3)   "Travel by motor vehicles" means movement of any motor vehicle upon the land in such a place as to come into close proximity to parked motor vehicles or persons leaving or approaching parked motor vehicles.
      (4)   "Owner" means any person entitled to the use and possession of the land, whether as freeholder, vendee, lessee, tenant or otherwise.
      (5)   "In the owner's service" means owned, driven or leased as lessee by the owner, his agent, employee, independent contractor or other person with a pre-existing contractual relationship to the the owner, which relationship contemplates such use of the owner's land. Motor vehicles under bailment solely for parking or storage or the rendition of services thereon by the owner shall not be deemed in the owner's service although driven exclusively by one of the foregoing while on the owner's premises.
      (6)   "Parking lot" means a public parking lot, or a private parking lot, or both, as the context may require.
   (b)   No person shall park upon, or otherwise use, a parking lot in violation of regulations of the following types conspicuously posted on or about such parking lot:
      (1)   Concerning prohibition of the use of the parking lot or some portion thereof by motor vehicles of certain types or weights. However, no owner shall be required to post signs prohibiting a use by a vehicle which obviously cannot be reasonably accommodated;
      (2)   Concerning prohibition of the use of the parking lot or some portion thereof by motor vehicles being driven for other than certain specified purposes or by other than certain persons or classes of persons;
      (3)   Concerning payment for the privilege of parking.
   (c)   No person other than the owner or his duly authorized agent shall post any signs purporting to establish such regulations.

   (d)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
351.16 NO PARKING ZONES.
   (a)   The following parking restrictions are hereby established within the Village of Sunbury:
      (1)   No Parking Anytime.
   West Cherry Street from the Village Limit to Columbus Street
North Columbus Street from Sedgwick to Cherry Street (west side of road only)
North Columbus Street from Sedgwick to Rainbow (east side of road only)
North Columbus Street from Harrison to Cherry Streets (east side of road only)
South Columbus Street from Cherry Street to Letts Avenue
Harrison Street from Columbus Street to Vernon Street
North Street from Vernon Street to Morning Street (south side of road only)
East Cherry Street from Vernon Street to Morning Street (north side of road only)
East Granville Street from S. Vernon Street to Morning Street
South Vernon Street from E. Granville Street to the curve (east side of road only)
East Cherry Street from Morning Street to entrance to J.R. Smith Park (south side of the road only)
High Street from Otis Street to Harrison Street
Middleview Drive (the entire length of the road)
Miller Drive (north and south)
West Granville Street
North Vernon Street from Sedgwick to Fairview Drive
North Vernon Street (east side from Fairview to Fairview)
Fairview - west side from North Vernon to Greenbriar Road
Greenbriar Road from Fairview (the first 200 feet)
South Vernon Street from E. Granville Street (the first 190 feet)
South side of Letts Avenue from intersection with Columbus Street (150 feet to east)
West Granville Street from State Route 3 to where it dead ends
Evening Street from West Cherry Street to curve
         Hawthorne Road (200 Block Only)
         Southview Drive (no parking both sides of road within 60 feet of intersection of Middleview Drive)

         North side of Fairland Drive from Woodchuck Drive to Miller Drive
         South side of Fairland Drive from Miller Drive to west end of Fairland Drive (where dedicated right of way becomes private drive to Big Walnut Middle School) (Ord. 2015-26. Passed 9-16-15.)
         Heartland Meadows Drive from S. Miller Drive to Southworth Drive on both sides of the road.
         Heartland Meadows Drive adjacent to General Rosecrans Elementary School:
            On the west side of Heartland Meadows Drive from S. Miller Drive to Millstone Drive;
            On the east side of Heartland Meadows Drive from the centerline of South Miller Drive south a distance of 125 feet;
            On the east side of Heartland Meadows Drive from the intersection with Southworth Drive northward 100 feet past the centerline of the driveway to General Rosecrans Elementary School from 7:00 a.m. to 4:00 p.m. on days when Big Walnut Local Schools are in session only.       (2)   No person shall park a vehicle on a street, highway or public right-of-way immediately following a snowfall resulting in accumulation from either snowfall and/or blowing and drifting of snow of three (3) inches or more until that street is clear of snow. Any vehicle parked in violation of this section shall be subject to removal and impoundment as provided in Section 351.16 (a) (d) of the codified ordinances of the Village of Sunbury.

      (3)   No Parking Anytime Towaway Zone.
         Hill Street from Letts Avenue to Baughman Street
         East Street from Letts Avenue to Baughman Street (east side of road only)
      (4)   20 Minute Parking 7 a.m. to 4 p.m. Monday through Friday.
Baughman Street from Hill to East Street (south side of the road only)
      (5)   No parking 7 a.m. to 4 p.m. Monday through Friday.
   Letts Avenue from South Columbus Street to East Granville Street (north side of the road only)
   (b)   For a violation of the parking regulations established in subsection (a)(1) through (5) hereof, the following penalties are established:
      (1)   If paid within thirty days of the violation: $15.00.
      (2)   If paid after thirty days of the violation: $25.00.
      (3)   After thirty days of the violation, a summons shall be issued for an unpaid citation.
   (c)   Subsections (a)(1) to (5) above shall not prohibit parking on pre-existing (as of May 21, 2003) paved or gravel parking areas located within the right of way but off the current paved street, and any future paved street should a street be widened, by adjoining property owners, their invitees or guests. This shall not be construed to confer any present or future legal rights to adjoining property owners, their invitees or guests in the public right of way except as expressly set forth herein. Further, this limited exception to the no parking provisions of this section may be rescinded at any future time by action of Sunbury Village Council.

   (d)   A snowfall of three (3) inches or more is hereby automatically declared to constitute a snow emergency for the purpose of removing snow from all streets, highways and public rights-of-way to facilitate safe vehicular travel. Any motor vehicle that is parked in a street, highway or public right-of-way following a snowfall of three (3) inches or more may be towed from the parking location and impounded by the Sunbury Police Department. A motor vehicle that is so towed shall not be released to its owner until the owner presents proof of ownership of the motor vehicle and pays all towing and storage fees normally imposed by the municipality for towing and storing motor vehicles. If the motor vehicle is a leased vehicle, it shall not be released to the lessee until the lessee presents proof that a person is the lessee of the motor vehicle, and pays all towing and storage fees normally imposed by the municipality for towing and storage of motor vehicles. The Village administrator or other appropriate Village of Sunbury representative is authorized to make reasonable efforts to notify residents of a snow emergency via local media and by posting at the Sunbury Municipal Building and on the Village of Sunbury website, however the owners and operators of motor vehicles shall have full responsibility to determine existing weather conditions and to comply with emergency parking regulations set forth in Section 351.16 notwithstanding any notification authorized herein.
