§ 133.43 TRESPASSING ON SCHOOL PROPERTY.
   (A)   A person, 18 years of age or older, shall not enter any public, private or parochial school building during school days and school hours, without express permission from an administrator of that building, or unless they meet the requirements of divisions (C)(3) or (4) below. A warning shall not be necessary prior to enforcement of this section.
   (B)   A person, 18 years of age or older, shall not enter upon the grounds of any public, private or parochial school during school days and school hours unless they meet a requirement of divisions (C)(3) or (4) below. A warning shall not be necessary prior to enforcement of this section.
   (C)   This section shall not apply to the following:
      (1)   A student enrolled in the school;
      (2)   A teacher, staff member, registered volunteer or any other employee of the school ;
      (3)   A law enforcement officer, firefighter or other emergency worker acting in the performance of their duties;
      (4)   A person entering the school at a designated entrance and reporting by the most direct route to the main office of the building in accordance with district policy;
      (5)   A parent, guardian or other adult responsible for an enrolled student who is dropping off or picking up the student in accordance with district policies.
   (D)   A public, private or parochial school may establish policies allowing for the use of athletic fields or facilities by the public during school days and school hours by persons who would otherwise be in violation of this section. If a school elects to establish such a policy, they shall notify the Sheriff's Department in writing of any activity they are permitting.
   (E)   As used in this section:
      (1)   ADMINISTRATOR. A superintendent, principal, assistant principal or a designee for such.
      (2)   SCHOOL DAYS. Days in which classes are held at the school.
      (3)   SCHOOL HOURS. One-half (1/2) hour before the start of classes through (1/2) hour after the end of classes.
   (F)   Violations and penalties. A person who violates this section is guilty of a misdemeanor and may be imprisoned for not more than 90 days or fined not more than $500.
