§ 97.05 HOURS.
   (A)   Except as otherwise provided in this section, consumer fireworks shall not be ignited, discharged or used in the township.
   (B)   Fireworks may be discharged after 11:00 a.m. on the following dates:
      (1)   December 31 until 1:00 a.m. on January 1.
      (2)   The Saturday and Sunday immediately preceding Memorial Day until 11:45 p.m. on each of those days.
      (3)   June 29 to July 4 until 11:45 p.m. on each of those days.
      (4)   July 5, if that date is a Friday or Saturday, until 11:45 p.m.
      (5)   The Saturday and Sunday immediately preceding Labor Day until 11:45 p.m. on each of those days.
   (C)   The Township Supervisor or a designee may approve a permit for a person, business or entity to ignite, discharge or use consumer fireworks on days other than those outlined above. Such a permit shall specify the specific location(s), specific day(s) and time(s) consumer fireworks may be ignited, discharged or used as well as any other special terms the township representative deems necessary.
      (1)   A person who fails to comply with all the terms of a permit issued by the township is considered in violation of this section.
      (2)   The Township Supervisor and/or a designee shall notify the Fire Department and the Jackson County Sheriff's Office in writing of any permits granted under this section.
   (D)   Pursuant to M.C.L.A. § 28.457(3), a person who violates this section is responsible for a municipal civil infraction and shall be fined $1,000 for each violation. Five hundred dollars ($500) of the civil fine shall be remitted to the law enforcement agency taking enforcement action.
