(A) Generally. The following regulations shall apply to secondhand and antique dealers.
(B) Specifically.
(1) Every secondhand dealer or antique dealer must maintain a book or record in which the following must be entered for every secondhand good or antique acquired:
(a) A description of the item, including serial numbers, model numbers, brand name, color and other identifying marks or data;
(b) The name, description, driver’s license number, and residence of the person from whom the item was purchased;
(c) The license number of any motor vehicle used to transport the goods to the recipient; and
(d) The date and time when the purchase or acquisition of the item was made.
(2) Each entry made in the book or record shall be numbered consecutively, each commencing with the number “1.”
(3) (a) Books and records kept must be available for inspection by officers of the Sheriff’s Department and the Township Ordinance Officer.
(b) A refusal to permit inspection, or interference with or obstruction of, the inspection will be deemed a violation of this subchapter.
(4) (a) All secondhand goods or antiques purchased or acquired must be retained for a period of at least 7 days before sale or disposal.
(b) A tag shall be attached to each article in a visible and convenient place.
(c) The tag shall contain a number corresponding with the entry number in the book or record provided for in division (B)(2) above.
(d) During the period while the goods are in the possession of the dealer, they will be subject to inspection at any time by any officer of the Sheriff’s Department or the Township Ordinance Officer.
(e) Refusal to permit inspection will be deemed a violation of this subchapter.
(5) All dealers must require the presentation of photo identification by sellers, so as to verify the seller’s name and other information, as well as for verification of the seller’s age.
