An outdoor wood-fired boiler may be installed and used in the township only in accordance with all of the following provisions:
(1) The outdoor wood-fired boiler as defined in this ordinance shall be installed and used only on a lot with a minimum of twenty thousand square feet in area, a minimum of one hundred twenty feet in width and used for residential purposes. This does not apply to accessory buildings located in the Agricultural District having lot greater than 3 acres in size.
(2) The outdoor wood-fired boiler shall not be used to burn refuse and shall only burn clean wood in the boiler. Other fuel sources as recommended by the manufacture of an outsider boiler and not specifically prohibited by this ordinance may be permitted.
(3) The outdoor wood-fired boiler shall be located at least 100 feet from the nearest building which is not on the same property as the outdoor wood-fired boiler.
(4) The outdoor wood-fired boiler shall have an attached permanent chimney that extends at least as high above the ground surface as the height of the roofs of all such residences if there is a residence within 200 feet of the wood-fired furnace not on the same property. The Fire Chief and Building Inspector or their designee(s) may approve a lesser height on a case-by-case basis if necessary to comply with manufacturer's recommendations and if the smoke from the lower chimney height does not create a nuisance for neighbors. This approval may be revoked by the Fire Chief and Building Inspector or their designee(s) upon compelling evidence.
(5) The outdoor wood-fired boiler shall be UL listed and have attached an approved U.S. Environmental Protection Agency (EPA) label. The label shall indicate the model being installed including the test results from an independent accredited laboratory showing the unit meets the EPA 2007 (Phase 1) voluntary testing program for emissions levels for outdoor wood-fired hydronic heaters (OWHH).
(6) The owner or occupant of the property shall obtain all required permits for each outdoor wood-fired boiler prior to installation and any required inspections shall be completed and approved prior to use of the outdoor wood- fired boiler.
(7) The lawful use of a nonconforming outdoor wood-fired boiler existing at the time of the adoption or amendment of this chapter may be continued although such boiler does not conform to the provisions of this section. Notwithstanding the foregoing, a nonconforming outdoor wood-fired furnace shall not be used or operated in such a manner so as to constitute public nuisance or so as to cause a condition which is hazardous to human health and is prohibited by any applicable federal, state or local statutes, ordinances, or regulations.
