(a) Whoever violates any provision of this chapter shall be subject to the following schedule of fines and penalty:

First | $ 50.00 fine |
Second | 250.00 fine |
Third | 500.00 fine with confiscation of the sound equipment involved. |
(b) All equipment that is removed from a vehicle shall be removed by a private professional or professionals contract with by the local law enforcement, who possesses their own liability insurance and who would insure correct procedures and accountability in removing the equipment from the vehicle. All equipment shall be stored by the local law enforcement department for a minimum of ninety (90) days. All equipment shall be picked up between 91 and 120 days of confiscation. All equipment that is not picked up, after 121 days of confiscation, shall be sold by local law enforcement sale. The person who received the citation for the offense, is responsible for all fines, removal costs, storage costs, retrieval costs and any other costs associated with such citation.
