145.06 SOUTHERN SUMMIT COUNTY URBAN JOBS AND ENTERPRISE ZONE.
   (a)   The Council of the County of Summit does hereby designate and establish within Summit County the Southern Summit County Urban Jobs and Enterprise Zone, the area to be included therein being described in the map attached to original Resolution 93-742 as "Exhibit A", and as more fully described in "Exhibit B" to original Resolution 93-742, and including within its boundaries certain municipalities and townships and portions of municipalities and townships, being the cities of Green and Norton, and townships of Coventry and Franklin.
   (b)   There is hereby formed within each municipality and township within the Southern Summit County Urban Jobs and Enterprise Zone a Tax Incentive Review Council composed of seven (7) members as follows: three (3) members appointed by the County Executive, subject to confirmation by County Council; two (2) members appointed by either the mayor of the municipality, with the concurrence of its council, or the board of township trustees; the County Fiscal Officer, or his designee; and one (1) member of the board of education of the affected school district. Each Tax Incentive Review Council shall be appointed within sixty (60) days of the effective date of this section. At least two (2) members shall be residents of the municipality or township to which the agreement applies. Annually, each Tax Incentive Review Council shall review all outstanding agreements within its jurisdiction to determine whether the enterprises are in compliance therewith, and shall make recommendations regarding each agreement to the County Executive and the mayor and council of board of trustees to which the agreement applies. The County Executive may take any action available to a party to a contract to obtain compliance with the agreement.
   (c)   The County of Summit does hereby delegate to the legislative authority of each municipality or board of township trustees all powers and duties given to counties by Ohio R.C. 5709.63 to negotiate and administer agreements with regard to enterprises located or locating in its boundaries within the zone. All agreements shall be approved by the County Executive.
   (d)   In addition to the powers and duties given to municipalities and townships by Ohio R.C. 5709.61 through 5709.66, inclusive, such municipalities and townships shall also have the power to require any enterprise entering into an agreement to provide the community with reasonable filing or applications fees, require information in addition to that required by the Ohio Department of Development, require contributions to the community for specific public purposes or improvements, and to exercise jointly powers and duties allowed or imposed by Ohio R.C. 5709.63 for a single enterprise locating within more than one (1) political jurisdiction within the zone.
   (e)   After an agreement made pursuant to Ohio R.C. 5709.61 through 5709.66, inclusive, is entered into by and of the participating municipalities or townships, and the designation of the zone is revoked, in whole or in part, by the County or any municipality or township, or if the Ohio Department of Development revokes certification of the zone, any entitlement granted under the agreement shall continue for the number of years specified in such agreement.
   (f)   The County Executive be and hereby is authorized to make application to the Ohio Department of Development for certification of the designated area, contained in "Exhibit A" to original Resolution 93-742 and "Exhibit B" attached to original Resolution 93-742, as an urban jobs and enterprise zone and to approve agreements entered into by the participating municipality or township.
