138.02 COUNTY COUNCIL; POWER TO CHOOSE LEGAL REPRESENTATIVE.
   (a)   Under the authority of Article IV, Section 4.01 of the Summit County Charter, County Council is hereby authorized to choose either the Prosecuting Attorney as their legal representative in any civil matter, including representation in any court of law or equity, whether state or federal, or to hire outside counsel without the County Prosecutor’s consent.
   (b)   Under the authority of Article IV, Section 4.01, of the Summit County Charter, County Council is hereby authorized to approve, without the consent of the Prosecuting Attorney, the hiring of outside counsel to represent it in any legal matter or proceeding. All duties and functions of the Prosecuting Attorney, whether arising under the Summit County Charter, Summit County Codified Ordinances, Council resolution, or general law to recommend to the County Council, in accordance with the provisions of the Summit County Codified Ordinances concerning professional contracts, that outside legal counsel be retained to represent County Council are hereby transferred from the Prosecuting Attorney to County Council.
