137.02 COOPERATIVE PURCHASING CONTRACTS WITH OHIO DEPARTMENT OF TRANSPORTATION.
   (a)   The County Engineer hereby requests authority in the name of the County of Summit to participate in contracts of the Ohio Department of Transportation for the purchase of machinery, materials, supplies or other articles which the Department has entered into pursuant to Ohio R.C. 5513.01(B). Such participation must still comply with all local rules and regulations currently in effect including Board of Control and Council approval as necessary.
   (b)   The County Engineer is hereby authorized to agree in the name of the County of Summit to be bound by all terms and conditions as the Director of Transportation prescribes.
   (c)   The County Engineer is hereby authorized to agree in the name of the County of Summit to directly pay the vendor, under each such contract of the Ohio Department of Transportation in which the County of Summit participates, for items it receives pursuant to the contract.
   (d)   The County of Summit agrees to hold the Director of Transportation and the Ohio Department of Transportation harmless for any claim or dispute arising out of participation in a contract pursuant to Ohio R.C. 5513.01(B).
