(a) The Department of Law and Risk Management is hereby authorized to represent the County Executive, and all departments under the authority of the County Executive, in all courts of law and equity, both state and federal, and to prosecute and defend all suits in which the County Executive, or any department under the authority of the County Executive, is a party.
(b) The Department of Law and Risk Management is hereby authorized, without consultation with the County Prosecutor, to recommend to the County Council, in accordance with the provisions of the Summit County Ordinances concerning professional contracts, that outside legal counsel be retained to represent the Summit County Executive, or any department under the authority of the County Executive, in a particular suit or proceeding, whether state or federal.
