The contractor or developer shall obtain all easements, rights-of-way or other authorization necessary for the completion of the work unless the agreement, plans and specifications provide otherwise. A road opening permit shall be obtained from the proper authorities for any construction within the road right of way, and the contractor shall be solely responsible for all costs, construction practices and restoration requirements imposed therein.
