926.03 COMMUNITY DISCHARGE PERMIT.
   (a)    The County shall issue permits to communities with requirements, conditions, and performance objectives as necessary to achieve the purpose of this chapter.
   (b) The County shall notify a community by certified mail of actions the community shall be required to undertake under the authority of this chapter and applicable sewer use agreements. The permit shall contain or require the following information at a minimum:
(1)    General conditions.
(2)    Performance objective, including peak flow limitations.
(3)    Community Compliance Plan, including general conditions, compliance schedule as required, and special conditions of approval.
   (c)    The County shall notify a community by certified mail of the required schedule for preparation and submittal of the fact sheet and community compliance plan identifying the means by which the community intends to achieve its performance objectives.
   (d)    Upon approval by the County of a community compliance plan, such plan, including a schedule of compliance, shall be deemed incorporated into the respective community discharge permit for all purposes of this Code. The failure of a community to submit or obtain County approval of a plan within ninety (90) days of the required submittal date shall be deemed a circumstance for initiation of enforcement action pursuant to Sections 926.09 through 926.99.
   (e)    Permit Modifications, Suspension or Revocation. After notice and opportunity for a hearing, the community discharge permit may be modified, suspended or revoked by the Director in whole or in part during its effective term. The County shall retain the right of revision to amend the Code or the granted permit. In the event of said modification or amendment, the County shall notify the permitee not less than thirty (30) days prior to the effective date of such modification or amendment to its community discharge permit.
   The community may, at any time, apply for modification of any part of its community discharge permit. The application should be submitted to the County at least ninety (90) days before the date on which it is desired that the modification become effective.
