926.02 TRIBUTARY COMMUNITY DISCHARGE PROGRAM.
   (a)    A tributary community discharge program shall be implemented through the issuance of community discharge permits. The permits shall delineate, among other things, the annual average flow rates and peak design flow rates which can be discharged to a given point of discharge or meter station, the elimination of separate sanitary sewer overflows up to the specified design storm event, the ban of combined storm sewers, and best management practices for operation and maintenance of sanitary collection systems.
   (b)    Each community shall, as a condition of its permit, be required to initiate and continue best management practices identified in its permit.
   (c)    Each community shall operate its sanitary collection systems under the supervision of a State Certified Operator's License. If the community does not have the appropriate certification, the County will require compliance within eighteen (18) months of the date of permit issuance.
   (d)    Each community shall identify and disclose to the County, as soon as they become known, all separate sanitary sewer overflow points/facilities and all combined sewer overflow points/facilities known or which become known to the community that are not included on the County's inventory.
   (e)    Each community is to evaluate and select the means by which the performance objectives identified in a given community discharge permit can be achieved, and to design, construct, finance and maintain the necessary improvements. The community shall also initiate and continue best management practices identified in its permit. The implementing community shall be solely responsible for projects set forth in its community compliance plan and for compliance with the performance objective(s) identified in its community discharge permit.
   (f)    No New Sanitary Overflows. No sanitary overflows shall exist except for those that are controlled in accordance with the community discharge permit. Construction of new sanitary sewer overflows is prohibited. All identified or newly identified sanitary sewer overflows not controlled in accordance with the community discharge permit shall be eliminated. The elimination shall be spelled out in the community compliance plan.
   (g)    No Combined Sewers. Construction of new combined sewers is prohibited. All identified or newly identified combined sewers shall be eliminated. The elimination shall be spelled out in the community compliance plan.
   (h)    Performance objectives shall be achieved as soon as practicable. As soon as practicable shall be determined on a case by case basis considering all relevant factors. These factors shall primarily include, but are not limited to, the following:
      (1)    The date on which the County sewer, if any, to which a peak flow reduction performance objective is related or for which an overflow control performance objective is dependent, is available to receive flow or required to realize a peak flow reduction.
       (2)    The reasonable time necessary to plan, design and construct the required facilities, including rehabilitation.
       (3)    Financial considerations.
      (4)    Impact of any delay upon receiving streams and facilities to which the flow is tributary.
       (5)    Externally imposed schedule requirements.
   (i)    Each community shall maintain a current map of all sanitary sewers tributary to the County. A copy is to be supplied to the County on an annual basis or as requested by the County.
