109.04 RECORDS COMMISSION.
   (a)    There is hereby created the Summit County Records Commission, which shall operate pursuant to Chapter 149 of the Ohio Revised Code.
   (b)   The Summit County Records Commission shall be comprised of the County Executive, President of Council, County Prosecuting Attorney, County Fiscal Officer, and the Clerk of the Court of Common Pleas or their designees.
   The Chief of Staff and Clerk of Council are hereby designated as alternates to the President of Council.
   (c)   Pursuant to Section 149.412(B) of the Ohio Revised Code, the County Executive is hereby authorized to enter into an agreement with any special taxing district, the territory of which is coextensive with the territorial limits of Summit County, for the Summit County Records Commission to be designated as the records commission for that special taxing district. Said agreement shall provide that the Summit County Records Commission is authorized to exercise all of the duties and responsibilities of the special taxing district records commission and shall further set forth the terms and conditions under which the Summit County Records Commission will perform public records-related functions, including establishing records retention and destruction schedules on behalf of the special taxing district.

   (d)   The County Executive is hereby authorized to enter into an agreement with any council of governments established pursuant to Chapter 167 of the Ohio Revised Code of which the County of Summit is a member, for the Summit County Records Commission to be designated as the records commission for that council of governments. Said agreement shall provide that the Summit County Records Commission is authorized to exercise all of the duties and responsibilities of a records commission for the council of governments and shall further set forth the terms and conditions under which the Summit County Records Commission will perform public records-related functions, including establishing records retention and destruction schedules on behalf of the council of governments.
