(a) In case of accident or collision with persons or property upon waters within the County, due to the operation of any watercraft, the person operating, having knowledge of such accident or collision, shall immediately stop at the scene of the accident or collision, to the extent that it is safe to do so, and shall remain at the scene of such accident or collision until he has given his name and address and, if he is not the owner, the name and address of the owner of such watercraft, together with the registered number of such watercraft, to any person injured in the accident or collision or to the operator, occupant, owner or attendant of any watercraft damaged in the accident or collision, or to any law enforcement officer at the scene of such accident or collision. In the event the injured person is unable to comprehend and record the information required to be given by this section, the other operator involved in the accident or collision shall forthwith notify the nearest law enforcement authority concerning the location of the accident or collision, and his name, address and the registered number of the watercraft he was operating, and then remain at the scene of the accident or collision or at the nearest location from which notification is possible until a law enforcement officer arrives, unless removed from the scene by an emergency vehicle.
(b) If such accident or collision is with an unoccupied or unattended watercraft, the operator so colliding with such watercraft shall securely attach the information required to be given in this section, in writing, to a conspicuous place in or on such unoccupied or unattended watercraft and shall, within twenty-four (24) hours after such accident or collision, forward to the appropriate law enforcement agency the same information required to be given to the owner or person in control of such damaged watercraft and give the date, time and location of the accident or collision.
(c) If such accident or collision is with any real property, dock or other personal property, other than a watercraft, the operator shall immediately stop and take reasonable steps to locate and notify the owner or person in charge of such property of such fact, of his name and his address, and of the registration number of the watercraft he is operating, and shall, within twenty-four hours after such accident, forward to the appropriate law enforcement agency the same information required to be given to the owner or person in control of such prperty and give the location of the accident and a description of the damage insofar as it is known.
(d) The operator of any watercraft involved in any accident resulting in the death of any person shall report the accident in writing within twenty-four (24) hours to the Chief of the Division of Watercraft, County Sheriff and any law enforcement agency having jurisdiction over the water where such accident occurred. The operator of any watercraft involved in any accident resulting in bodily injury to any person or damage to the property of any person in excess of two hundred dollars ($200.00) shall report the accident in writing within five (5) days to the above authorities. If the operator is physically incapable of making the report and there is another participant in the accident not so incapacitated, such participant shall make the report. In the event that there is no other participant, and the operator is other than the owner, the owner shall, within the prescribed period of time, make the report.
(e) The written report required by this section shall contain the same information and be in the same form as that required by Section 1501:47-1-09 of the Ohio Administrative Code regarding boating accidents.
