(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(B) Any owner, manager or employee of a commercial establishment which allows for the on-premises consumption of beer, ale, porter and/or wine who allows the commercial establishment to continue operations during the hours of 2:00 a.m. and 6:00 a.m. on Mondays thorough Saturdays shall be in violation of § 132.26 and the same shall constitute a criminal offense and such person(s) shall be punishable by the Municipal Court of the town or other court of competent jurisdiction. Each violation of § 132.26 shall subject the person so violating to a fine of $500 and/or 30 days in jail.

(D) Violators of the town’s permit required by § 132.24 shall be subject to the payment of required fees plus $500 per day, each day being a separate offense.

(E) Each violation of § 132.27 shall subject the person so violating to a fine of $500 and/or 30 days in jail.

(F) Any persons violating any provision of § 132.28 shall be deemed guilty of a misdemeanor and shall be subject to a fine of up to $500 plus court costs or imprisonment for not more than 30 days or both upon conviction.

(G) (1) The Police Department has primary responsibility for enforcement of § 132.31. The Police Department is authorized to take any and all other actions reasonable and necessary to enforce § 132.31 including, but not limited to, investigating violations, issuing fines and entering the premises of any business establishment during business hours. However, any enforcement officer or official of the town, including Beach Services Officers, and other Code Enforcement officials may enforce this section.
(2) In addition to the penalties set forth in § 132.31, repeated violations of § 132.31 by a person who owns, manages, operates, is a business agent of, or otherwise controls a business establishment may result in the suspension or revocation of the business license issued to the premises on which the violations occurred. No town business license shall be issued or renewed until all fines outstanding against the applicant for violations of this section are paid in full.
(3) Violation of § 132.31 is hereby declared to be a public nuisance, which may be abated by the town by restraining order, preliminary and permanent injunction, or other means provided for by law, and the town may act to recover the costs of the nuisance abatement.
(4) Any violation of the regulations provided in § 132.31 by any person or owner, manager, employee or representative of a business establishment shall be punishable as a misdemeanor and by a fine of up to $500, plus state assessments per day violation and/or a sentence of 30 days in jail. Each day the violation continues or occurs shall constitute a separate offense.
