Any person who is asked or told to vacate a commercial establishment as defined in § 132.26 before 2:00 a.m. on Mondays through Saturdays and refuses to vacate, such refusal shall constitute a violation of this section and shall constitute a criminal offense and such person(s) shall be punishable by the Municipal Court of the town or other court of competent jurisdiction.
