§ 70.11 OVERSIZED VEHICLES.
   (A)   Exemptions. All emergency vehicles, including police, fire, and rescue, are exempt from the definition of oversized vehicle in § 70.01. In addition, maintenance vehicle or construction equipment as defined in § 70.01 shall also be exempt.
   (B)   Permits required for oversized vehicles. In order to maintain traffic safety, oversized vehicles, as defined in § 70.01, shall be required to obtain a permit to travel on any village street or road prior to entering village limits. The application for the permit shall be obtained from Village Hall and returned to the Zoning Administrator with all the required information, supporting documentation, and forms at least two weeks prior to the intended use of the village streets. Applicant shall be responsible for all damages to private and/or public property that may occur during the permitted use.
   (C)   Permit requirements. The application for permit shall include the following information:
      (1)   Describe the purpose of the use of the oversized vehicle;
      (2)   Provide the exact dimensions of the oversized vehicle;
      (3)   Provide a map of the requested route to be used;
      (4)   Provide the date and time the roads will be requested for use;
      (5)   Attach information showing proof of liability insurance coverage, with minimum coverage of $1,000,000;
      (6)   Submission of a performance bond in the amount of $10,000. Said bond must be drawn upon an institution within the state; and
      (7)   Prepayment of a permit/escort fee of $1,500 to the village to cover the cost of four hours of police and public works escort service for travel on the village roads. Of the $1,500, $250 is for the permit and is nonrefundable. The remaining $1,250 will be refunded in full if additional hours over the four-hour time limit will be assessed at a rate of $45 per person, per hour. The village reserves the right to withhold refunding of the $1,250 should damage occur during the escort process on village roads or should village equipment or additional personnel be required.
   (D)   Additional requirements. The permittee shall be required to conform with the following.
      (1)   The transport of an oversized vehicle shall be scheduled Monday through Thursday only, (except for holidays), to begin between the hours of 10:00 a.m. and 12:00 p.m. Other times and days will not be permitted unless prior approval has been granted by the Village Manager.
      (2)   No tree on private or public property shall be cut without the permission of the property owner. The permittee shall have an arborist with an ISA certification available to accompany the oversized vehicle to correctly move, trim, or cut any limbs, branches, or trees required by the move. Said arborist must inspect the route to be traveled and provide an assessment of trees that may be subject to damage, alteration, and/or removal before oversized vehicle enters village limits.
      (3)   Escort vehicles shall be provided in front of and behind the oversized vehicle.
   (E)   Inspection required. The permit is subject to a vehicle/load inspection by the Village Police Chief before final approval is given. Permitted uses subject to this section may be postponed to a later date or time as designated by the Police Chief, if in the opinion of the Police Chief the permitted use would, due to circumstances existing at the permitted day and time, endanger the public safety or welfare of the citizens and residents of the village. The Police Chief shall have authority to set the day and time for the postponed permitted use.
