§ 70.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   DRIVER. The operator of a vehicle.
   HIGHWAY or STREET. The entire width between property or right-of-way lines of every way or place of whatever nature, when any part thereof is open to the use of the public as a matter or right for the purpose of vehicular traffic. The terms HIGHWAY or STREET or a combination of the two terms shall be used synonymously.
   INTERSECTION. The area embraced within the prolongation of the lateral edge of roadway lines of two or more highways which join one another at an angle whether or not one such highway crosses the other.
   LOCAL STREET. A street within the village that is not part of the state highway system.
   MOTOR VEHICLE. Every vehicle that is self-propelled and every vehicle designed to run upon the streets that is pulled by a self-propelled vehicle.
   OPERATOR. A person in actual physical control of a vehicle that is in motion or that has the engine running.
   PARKING or STANDING. A vehicle is parked or is permitted to stand when it is stopped and allowed to remain in a fixed location for any duration of time, whether attended or unattended. Except where the context clearly indicates otherwise, the limitation on PARKING and STANDING in this chapter apply only to location within a street right-of-way. In no case do these limitations apply when a vehicle is stopped to avoid conflict with other traffic or in compliance with law or the directions of a police officer or traffic-control device or as the result of an emergency or because the vehicle is disabled due to mechanical failure.
   PUBLIC VEHICULAR AREA. 
      (1)   Any area within the state that is generally open to and used by the public, including, by way of illustration and not limitation, any drive, driveway, road, roadway, street, alley, or parking lot upon the grounds and premises of:
         (a)   Any public or private hospital, college, university, school, orphanage, church, or any of the institutions, parks, or other facilities maintained and supported by the state or any of its subdivisions;
         (b)   Any service station, drive-in theater, supermarket, store, restaurant, or office building, or any other business, residential, or municipal establishment providing parking spaces for customers, patrons, or the public; or
         (c)   Any property owned by the United States and subject to the jurisdiction of the state. (The inclusion of property owned by the United States in this definition shall not limit assimilation of state law when applicable under the provisions of 18 U.S.C. § 13.)
      (2)   The term PUBLIC VEHICULAR AREA shall also include any road opened to vehicular traffic within or leading to a subdivision for use by subdivision residents, their guests, and members of the public, whether or not the subdivision roads have been offered for dedication to the public. The term PUBLIC VEHICULAR AREA shall not be construed to mean any private property not generally open to and used by the public.
   TRAFFIC-CONTROL DEVICE. Any sign, signal, marking, or other device placed or erected pursuant to a lawful ordinance and designed to control, regulate, warn, and guide traffic.
   VEHICLE. Every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon fixed rails or tracks, provided, that for the purposes of this chapter, bicycles shall be deemed VEHICLES and every rider of a bicycle upon a highway shall be subject to the provisions of this chapter applicable to the driver of a VEHICLE except those which by their nature can have no application.
      (1)   BUS. A vehicle primarily used for transporting people and their personal belongings. For the purpose of this chapter, a BUS shall include any vehicle which is designed to transport more than 20 persons and has a 21-foot maximum overall length.
      (2)   CONSTRUCTION EQUIPMENT. Machinery used in the excavation of land such as backhoes, track hoes, tractors, bulldozers, snow removal machinery, and paving equipment. In addition, vehicles transporting such equipment as stated above, cement trucks, cranes, and dump trucks may also be included. Exclusions from this definition include, but are not limited to, building materials and vehicles transporting building materials, structures, or portions thereof.
      (3)   MAINTENANCE VEHICLES. Any and all vehicles and/or machinery owned and operated by the village.
      (4)   OVERSIZED VEHICLE. A vehicle, including any trailer and its load, which includes any combination of dimensions over eight and a half feet in width, 13.5 feet in height, and 60 feet in length. The height shall be measured from the ground to the highest feature on the vehicle including any trailer on both sides of the vehicle, including any trailer and its load. The maximum width including overhang shall not exceed 13 feet, eight inches or no more than 75% of the amount of the narrowest road to be traveled, whichever is less. The length shall be measured from the front of the vehicle to the end of the vehicle, including any trailer and its load.
   VILLAGE MANAGER. The VILLAGE MANAGER or his or her designee is instructed to perform the function assigned by this chapter. Whenever this chapter authorizes or requires the VILLAGE MANAGER to install a traffic-control device controlling parking or regulating the movement of traffic on, to, or from a state highway system street, the VILLAGE MANAGER may discharge that responsibility by requesting the State Department of Transportation to install such device.
