§ 70.02 FIRE LANES.
   (A)   Whenever a street is designated a fire lane in accordance with division (B) below, no person shall park a vehicle or permit to stand, whether attended or unattended, upon any public vehicular area, street, highway, or roadway. The owner of a vehicle parked in violation of this section shall be deemed to leave appointed any village law enforcement officer as his or her agent for the purpose of arranging for the transportation and storage of such vehicle as established in § 70.10 and Chapter 71.
   (B)   Due to the widespread narrow village streets within the corporate limits of the village, the size of emergency vehicles, the limited amount of parking areas, at both private residences and the local ski resort, available for large numbers of people, the frequency of large inflows of people to said village during the year and, finally the extreme weather conditions present during the year, the Council finds that a potential hazard exists on each and every village street concerning the passage of an emergency vehicle. Therefore, the Council hereby designates all village streets and rights-of-way within the corporate limits of the village as fire lanes, and the Village Manager shall install appropriate traffic signs at the entrance to each village street indicating that it is a fire lane. However, the enforcement of the provisions of this section is not dependent on the installation of such signs.
   (C)   All construction personnel and service employees who are engaged in performing work within the village may park their vehicles on the street right-of-way only when such parked vehicles do not interfere or obstruct traffic and said owners are available immediately so that the removal of a vehicle will be prompt if so needed for any reason.
   (D)   No agent or employee of the village, no person or occupant of the premises from which any derelict or abandoned vehicle shall be removed, not any person or firm contracting for the removal of or disposition of any such vehicle shall be held criminally or civilly liable in any way arising out of or caused by carrying out or enforcing any provisions of this chapter.
   (E)   This section is written in accordance with G.S. § 20-162(b) and all authority, both expressed and implied, granted by the aforestated statute shall apply to the section.
