5-2-1-5: POSSESSION OF SPRAY PAINT BY MINORS:
   A.   Possession Prohibited:
      1.   Prohibition; Exceptions: No person under the age of eighteen (18) shall possess within the village any paint in a spray can. This prohibition shall not apply to:
         a.   A minor using paint in a spray can while under the immediate supervision of his or her parent, legal guardian or other responsible companion at least twenty one (21) years of age approved by his or her parent or legal guardian.
         b.   A minor using paint in a spray can while engaged in a supervised activity sponsored by his/her school, church or internal revenue code section 501(c)(3) not for profit community organization.
         c.   A minor using paint in a spray can at the direction and under the supervision of his or her employer. (Ord. 596, 2-14-1996)
      2.   Penalty: A person guilty of violating this subsection shall be subject to penalty as provided in section 1-4-1 of this code. (Ord. 596, 2-14-1996; amd. 1998 Code)
   B.   Aiding And Abetting Possession By Minors:
      1.   Prohibition; Exceptions: No person shall aid, assist or abet a person under the age of eighteen (18) in obtaining possession of paint in a spray can. This prohibition shall not apply to:
         a.   A parent, legal guardian or other responsible companion at least twenty one (21) years of age approved by the minor's parent or legal guardian who is assisting and supervising his or her child or ward in the use of paint in a spray can.
         b.   An employee of a school, church or internal revenue code section 501(c)(3) not for profit community organization assisting and supervising a minor in his or her charge in the use of paint in a spray can.
         c.   An employer assisting and supervising his or her employee in the use of paint in a spray can. (Ord. 596, 2-14-1994)
      2.   Penalty: A person guilty of violating this subsection shall be subject to penalty as provided in Section 1-4-1 of this Code. (Ord. 596, 2-14-1994; 1998 Code)
