541.10 TREES AND SHRUBS ON PRIVATE PROPERTY.
   (a)   All property owners in the Village shall maintain all trees and shrubs on their property so that the trees and shrubs do not become a hazard or nuisance to their neighbors.
   (b)   In the event the trees or shrubs are diseased, dead, broken or any other condition that becomes dangerous or hazardous to their neighbor's property, the Village shall notify the owner of the realty by mail with proof of mailing to last known address to correct the hazard within fifteen days of sending of the letter.
   (c)   In the event that owner of the real estate does not correct the hazard within the fifteen day period or ask for a reasonable extension of time for an excusable delay, the Village shall abate the condition by removing the hazard.
   The actual cost or two hundred dollars ($200.00) liquidated damage charge (whichever is higher) shall be assessed to the owner. In the event that the owner does not pay for the said charge within thirty days of the charge, such charge plus a collection fee of twenty-five percent (25%) shall be assessed to the real estate on the tax duplicate in the manner prescribed by law.
   (d)   In the event that the owner of the real estate does not abate the nuisance within the fifteen day period or any reasonable extension, the owner shall be subject to a fifteen dollar ($15.00) per day penalty.
