1167.01 PROCEDURE.
   Council may, from time to time amend, supplement or change the District Boundaries, or regulations herein, established or subsequently established. This shall be done in accordance with law and in the following manner:
   (a)   By filing with Council a petition, for the desired change, made on standard form prescribed by the Planning Commission, setting forth the necessary data, maps, plans, etc., all in accordance with requirements of this Zoning Ordinance.
   (b)   Adopting a resolution setting a time and location for a public hearing on the proposed change in the Zoning Map and Zoning Code; such date allowing thirty days consideration of the proposal by the Planning Commission and also authorizing the Clerk of Council to give thirty days notice by publication of the time and place of such hearing in the manner required by law.
   (c)   (1)   Adopting a Resolution submitting to the Village Planning Commission the proposed change in the Zoning Plan and Zoning Code.
      (2)   A copy of the text of such ordinance, measure of regulation, together with the maps or plans or copies thereof forming a part of or referred to in such resolution and the maps, plans and reports submitted to and by the Planning Commission shall be on file for public examination, in the office of the Zoning Inspector or in such other office as may be designated by Council.
   (d)   (1)   Any petition, request, or filing for the purpose of starting the legal proceedings to consider any amendment, supplement or a change in this Zoning Ordinance, whether the same is finally adopted or not, shall cost the applicant a filing fee of twenty-five dollars ($25.00), paid in advance, to the Zoning Inspector to pay the cost of clerical help, filing, advertising, etc. Such applicant shall furnish all data, maps, surveys, or other information at his own expense that is needed or is requested by either or both Council and the Planning Commission. If standard data, established by rules and regulations is required, then this must be furnished without request.
      (2)   When any petition is filed a map shall be attached to the same showing the present zoning and where the variance or variances desired are definitely located on the map.
   (e)   In case the proposed amendment, supplement or change be disapproved by the Planning Commission or a protest be presented duly signed and acknowledged by the owners of twenty percent (20%) of the frontage in the rear thereof, or by the owners of twenty percent (20%) of the frontage directly opposite the frontage directly opposite the frontage proposed to be altered, or by both adjacent owners, such amendment, supplement or change shall not be passed except by an affirmative vote of not less than three-fourths of the full membership of Council.
   (f)   Council shall take final action upon such amendment, supplement or change within a period of sixty days after the filing of petition for same with the Clerk.
   (g)   The failure of the Planning Commission to report to Council within the sixty days aforesaid shall be deemed to be an approval of such amendment, supplement or change.
