533.14 ADULT ENTERTAINMENT ESTABLISHMENTS.
   (a)   Unlawful Exposure by Patrons, Customers, Independent Contractors, Waiters, Waitresses, Employees, Owners, Entertainers and Performers in Food, Beverage or Alcohol Consumption Establishments.
      (1)   No patron or customer and no person while acting as a waiter, waitress, independent contractor, owner, employee, entertainer, or performer not performing, in an establishment which serves food, beverages, or food and beverages, including but not limited to alcoholic beverages, for consumption on the premises of the establishment, shall:
         A.   Expose his or her genitals, pubic hair, buttocks, perineum, anal region or pubic hair region; or
         B.   Expose any device, costume or covering which gives the appearance of or simulates the genitals, pubic hair, buttocks, perineum, anal region or pubic hair region; or
         C.   Expose any portion of the female breast below the top of the areola thereof.
      (2)   Whoever violates this subsection (a) is guilty of a misdemeanor of the first degree.
   (b)   Counseling or Assisting Unlawful Exposure Prohibited.
      (1)   No person shall cause, permit, procure, solicit, counsel or assist any person to expose or simulate exposure as prohibited in subsection (a) hereof.
      (2)   Whoever violates this subsection (b) hereof is guilty of a misdemeanor of the first degree. (Ord. 99-9774. Passed 3-12-99.)
   (c)   Conduct Within Entertainment Establishments. 
      (1)   Any and all live adult performances shall be performed on a platform or stage at least twenty-four inches above the immediate floor level and removed at least six feet from the nearest person.
      (2)   No person performing live adult performances shall solicit or accept any gratuity from any person.
      (3)   Whoever violates this subsection (c) hereof is guilty of a misdemeanor of the first degree.
   (d)   Definition. A person shall be deemed to be a waiter, waitress, performer or entertainer if such person acts in that capacity, without regard to whether or not such person is paid any compensation by the management of the establishment in which the activity is performed.
