(a) No person shall assembly with two or more other persons to do an unlawful act with force and violence, or do such unlawful act or agree with each other to do so and make preparation or movement therefore, or continue together after a proclamation is made by the Mayor that an emergency exists based upon view and information and based further upon evidence and information that persons are refusing to disburse and depart upon request of police officers or others designated by law to act.

(b) No person shall, during such emergency and after such proclamation, be upon the streets, sidewalks or other public places between the hours of 7:00 p.m. and 7:00 a.m. or during such periods of time as contained in the Mayor’s proclamation. However, any person or individual who is on the way to work or departing from his place of employment or who has proper and justifiable reason to utilize the public streets, sidewalks and areas and who is confronted with an emergency or who has legitimate business shall be permitted to proceed after proper interrogation or inquiry made by any police officer or duly authorized individual.
(c) The Mayor’s proclamation must be publicly made in order to give all inhabitants of the community and others notice of the existence of the emergency and conditions of the curfew.
(d) The Police Department or duly authorized police authority while engaged in suppressing a riot or when there is clear and present danger of a riot may cordon off any area threatened by such riot and may prohibit persons from entering such area, except when carrying on necessary and legitimate pursuits. They may prohibit the sale, offering for sale, dispensing or transportation of firearms or other dangerous weapons, ammunition, dynamite or other dangerous explosive in, to or from such areas. No person shall willfully fail to obey a lawful order of any Municipal officer, sheriff or other officer given pursuant to this section.

(e) Whoever violates subsection (a) hereof is guilty of a misdemeanor of the third degree. Such person shall also give security for good behavior and to keep the peace for one year. Whoever violates subsection (b) hereof is guilty of a minor misdemeanor. Whoever violates subsection (d) hereof is guilty of a misdemeanor of the first degree.
