(a) If the Owner resides (i) outside of the State of Ohio or (ii) within the State of Ohio, but outside of a twenty-five (25) mile radius of the Residential Rental Property, the owner shall designate a Local Responsible Agent. The Local Responsible Agent shall reside within the State of Ohio and within a twenty-five (25) mile radius of the Residential Rental Property. Any and all notices, summons, complaints and other legal documents issued to the Local Responsible Agent shall be deemed to have been issued upon the Owner.
(b) To ensure the continuous designation of a Local Responsible Agent by the Owner, the Local Responsible Agent shall be required to pay a security deposit with the City in an amount established by resolution of Council from time-to-time. The security deposit shall be returned to the Local Responsible Agent only if (i) the Owner provides sufficient evidence that the Owner is not required to designate a Local Responsible Agent under this Chapter or (ii) the Owner and/or the Local Responsible Agent terminate the Local Responsible Agent as the Owner's Local Responsible Agent and the Owner designates another Local Responsible Agent to replace the former Local Responsible Agent.
